Sebagaimana dikatakan Daniel S. Lev bahwa pengadilan merupakan salah satu simbol dari kekuasaan, dan Peradilan Agama adalah simbol dari dominannya kekuasaan Islam. Kemudian, pembahasan kedua, “Kedudukan Peradilan Syari’at Islam di Provinsi Nanggroe Aceh Darussalam dalam Sistem Peradilan di Indonesia”. Menjelaskan tentang struktur kelembagaan peradilan di Indonesia dengan keberadaan Peradilan Syari’at Islam, maka ia ditempatkan sebagai pengadilan khusus dalam dua lingkungan peradilan yang berbeda. Ketentuan ini belum selaras dengan Keputusan Presiden tentang Mahkamah Syar’iyah dan Mahkamah Syari’iyah Provinsi, serta Qanun tentang Pelaksanaan Syari’at Islam. Aturan ini prinsipnya menggariskan bahwa kekuasaan dan kewenangan Mahkamah Syar’iyah dan Mahkamah Syar’iyah Provinsi adalah kekuasaan dan kewenangan Pengadilan Agama dan Pengadilan Agama Tinggi.
