Diante de um contexto social de intensa degradação que atinge patamares de contaminação significativos, o ambiente torna-se uma preocupação cotidiana, sobressaindo, dentre os temas inerentes à tutela jurídico-penal ambiental , os delitos de acumulação (Kumulationsdelikte). Estes surgiram com a teorização proposta por Lothar Kuhlen, em 1986, a partir do §324 do StGB (crime de poluição das águas do código penal alemão) e da problemática do despejo de esgotos domésticos no Rio Main. Justificou-se assim a criminalização de ações individuais isoladamente inócuas que em repetição por um grande número de indivíduos poderia resultar em significativos danos ambientais. São considerados como desdobramentos dos delitos de perigo abstrato, embora não se confundam com estes por não ser exigida a geral perigosidade da conduta ao bem jurídico protegido em uma prognose ex ante. Na realidade, os delitos de acumulação constituem um mecanismo de imputação coletiva para o enfrentamento dos problemas ambientais da sociedade de risco, expondo as dificuldades de proteção do bem jurídico coletivo meio ambiente e as complexas relações de causalidade entre cada conduta individual e o dano ambiental cumulativo. Embora o pensador alemão tenha o mérito de trazer a lume um problema ambiental relevante com importantes reflexões sobre o Direito penal ambiental, sua proposta não tem o condão de justificar uma incriminação, carecendo de conteúdo o injusto, principalmente pela total carência de ofensividade das condutas criminalizadas. Propõem-se, então, os crimes de perigo abstrato em contextos instáveis como técnica de correção dos delitos de acumulação voltada à análise da real ofensividade das condutas perigosas aos complexos e frágeis bens jurídicos ambientais, partindo de três premissas: (i) o afastamento da lógica de repetição, em grande número, de condutas desprovidas de ofensividade ao bem jurídico; (ii) a assunção da forma de ofensividade de cuidado-de-perigo conforme o contexto instável; e (iii) a indispensabilidade do injusto material. Acredita-se que o cuidado-de-perigo é o limite da ofensa em Direito penal ambiental, não sendo legítimo a qualquer proposta ultrapassar este liame ou ignorar a ofensividade. Nos delitos ambientais o contexto é proeminente e não a acumulação de condutas, porque além da natural complexidade dos bens protegidos, estes já se encontram no raio de ação do perigo de determinados comportamentos. O contexto de instabilidade de fatores em que se encontram os bens ambientais (água, ar, solo, fauna, flora) será determinante para a análise da ofensividade. Através da categoria relacional de ofensa de cuidado-de-perigo, vinculada ao contexto fático no qual a conduta se desenvolve, que é possível compreender o injusto de perigo abstrato no âmbito do Direito penal ambiental. Com o fito de manter-se dentro de sua órbita de identidade, ainda que mínima, atendendo tanto aos parâmetros de legitimidade exigidos em um Estado democrático, quanto não ignorando o seu papel na proteção e conservação dos bens ambientais no Estado de direito ambiental, o Direito penal ambiental deve necessariamente conservar os seguintes elementos: (i) a proteção de bens jurídico-penais ambientais; (ii) a aplicação inescusável do princípio da ofensividade; (iii) e a vinculação ao injusto material.
