" The European colonial powers imposed their land laws on many countries in Africa, Asia and Latin America. These were often at variance with indigenous customs regulating land use. After attaining independence the new states mostly adhered to the colonial laws and did not revert to earlier customary law. The present volume contains contributions to a conference supported by the European Science Foundation and held at the Internationales Wissenschaftsforum Heidelberg in November 1991. The countries discussed by the authors include several West African states, India and Indonesia in Asia and Mexico and Surinam in Latin America. The volume should be of interest to anthropologists and historians as well as to law scholars. Dietmar Rothermund ist Professor für die Geschichte Südasiens am Südasien-Institut der Ruprecht-Karls-Universität Heidelberg. Jap de Moor arbeitet am Centre for the History of European Expansion, Universität Leiden, Niederlande. "

Excerpt from Short Lectures Explanatory of Our Land Laws Necessity of some knowledge of the history of the land laws - Manner of holding land in England before the Conquest - Effect of the Conquest on the holding of land - Introduction of the Feudal System - Fundamental principle of the land laws - Tenure - History and description of tenures - Different classes of estates: Freeholds Copyholds - Leases for terms of years - Varieties of freehold estates fh-estate for life. The law relating to the land of this country cannot be rightly understood without some previous know ledge of its history. It is not alone that its subtle theories, fine distinctions, restrictions, forms, and terminology cannot be made clear without some refer ence to their origin; but the law itself is very ancient, many of its rules having come down to us from the days when the foundations of our jurisprudence were laid. Some of the commonest every-day dealings with land derive their validity from Acts of the Parliaments of Edward I. And decisions of the Judges of Edward IV., while the modern changes in the law have touched the ancient system so lightly that an acquaintance with it is necessary before the very changes can be understood. From Kennebunkport to Kauai, from the Rio Grande to the Northern Rockies, ours is a vast republic. While we may be united under one Constitution, separate and distinct states remain, each with its own constitution and culture. Geographic idiosyncrasies add more than just local character. Regional understandings of law and justice have shaped and reshaped our nation throughout history. America's Constitution, our founding and unifying document, looks slightly different in California than it does in Kansas. In The Law of the Land, renowned legal scholar Akhil Reed Amar illustrates how geography, federalism, and regionalism have influenced some of the biggest questions in American constitutional law. Writing about Illinois, "the land of Lincoln," Amar shows how our sixteenth president's ideas about secession were influenced by his Midwestern upbringing and outlook. All of today's Supreme Court justices, Amar notes, learned their law in the Northeast, and New Yorkers of various sorts dominate the judiciary as never before. The curious Bush v. Gore decision, Amar insists, must be assessed with careful attention to Florida law and the Florida Constitution. The second amendment appears in a particularly interesting light, he argues, when viewed from the perspective of Rocky Mountain cowboys and cowgirls. Propelled by Amar's distinctively smart, lucid, and engaging prose, these essays allow general readers to see the historical roots of, and contemporary solutions to, many important constitutional questions. The Law of the Land illuminates our nation's history and politics, and shows how America's various local parts fit together to form a grand federal framework.

National Book Award Finalist: “A learned, thoughtful, witty legal history for the layman” (The New Yorker). What do the thoughts of a ravenous tiger have to do with the evolution of America’s legal system? How do the works of Jane Austen and Ludwig van Beethoven relate to corporal punishment? In The Law of the Land, Charles Rembar examines these and many other topics, illustrating the surprisingly entertaining history of US law. Best known for his passionate efforts to protect literature, including Lady Chatterley’s Lover, from censorship laws, Rembar offers an exciting look at the democratic judicial system that will appeal to lawyers and laymen alike. From the dark days of medieval England, when legal disputes were settled by duel, through recent paradigm shifts in the interpretation and application of the legal code, The Law of the Land is a compelling and informative history of the rules and regulations we so often take for granted.

Excerpt from The Land Laws Some words of introduction seem desirable in order to explain what this book aims at, and what it does not. The subject is the Land Laws of England, not those of Scotland or of Ireland, which, for different reasons, were beyond my plan. Scotland has a distinct legal system of her own with a distinct history; the study of it, a highly interesting one so far as with my slight knowledge of it I can judge, would be a separate undertaking. Irish land law, on the other hand, is nothing but imported English law with certain modifications. The only material modifications are those lately made in the relations of landlord and tenant, and they are too much involved with political controversies, and with still unsettled questions peculiar to Ireland, to be profitably treated in connection with English institutions. Dealing, then, with England alone, I have endeavoured to make the principles and the leading features of our law of real property intelligible to a reader who is without legal training, but is willing to take some little pains to understand. Essential Themes In Land Law And Customary Law written by Alexander Osei Tutu and has been published by Ghana Library Authority this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-06 with Law categories.

I have had the privilege to peruse through this book by the learned author, Justice Osei Tutu. And I have one adjective to describe the book: 'IMPRESSIVE'! The learned author and Justice of the High Court adds to the growing list of Justices of Ghana's Superior Courts who have authored law books which have indubitably contributed to enrich legal research and practice in this country. Particularly for practicing lawyers at the Bar, it is refreshing to have our judges author books, to not only add to the existing legal literature but to appreciate the mindset of our judges and perspective from the Bench, in whose bosom the law lies. Judges, as public officials, I surmise, have a great deal to contribute to demystifying principles of law and its practice at our courts; and this is what the author has accomplished by this book. The learned author, since his elevation to the High Court in 2013 has had a reputation for being a stickler for details and affirnity for scholarly writings and judgments - a skill such that he effortlessly brings to bear in this book. I thus strongly recommend this book to lawyers, law students and lecturers, who would without a smidgen of doubt, greatly find it instructive in their legal endeavours. Yaw Boafo Esq. National President, Ghana Bar Association Justice Alexander Osei Tutu demonstrates a finesse in legal thinking that few can match. This book comes to complement his bourgeoning legal scholarship and serves to enrich the literature in the diverse substantive and procedural fields of law the two volumes cover. Lawyers, Judges, scholars and students will truly find the book a handy source material in their endeavours. Professor Ernest Kofi Abotsi Dean, Faculty of Law, UPSA This book is not just another addition to myriads of works on Ghanaian land law but more importantly a critical perspective on aspects of our law that have been significantly affected by provisions of the new Land Act 2020 and the groundbreaking modifications being made by our Supreme Court to land law and customary law at a rather fast pace than before. The author does not merely synthesize these new developments but seeks to deploy probing scholarship in exploring these contemporary trends in Ghanaian law. The audacity of the author to pinpoint manifest problematic dimensions of the provisions of the new Land Act in relation to well known doctrines like allodial title, eminent domain, and spousal property rights provides unique enthusiasm that propels the reader to seek to engage other topics in different chapters of the book so as to arrive at the destination the author is gravitating towards with his thought provoking and critical expositions. Undoubtedly, the book deals with themes that are carefully selected in terms of currency, relevancy and utility to lawyers, judges, law makers, law students and members of the public. This great work must certainly be read by everyone who is determined to appreciate recalibration of many areas of Ghanaian law in contemporary times. Dr. Ernest Owusu-Dapaa Dean, Faculty of Law Kwame Nkrumah University of Science and Technology, Kumasi.

Excerpt from Our Land Laws, as They Are: A Handbook for Landowners, Candidates and Electrors At a time when further Reform of our Laud Laws forms part of the professed programme of both political parties, it may be that landowners, land-reformers and other thoughtful laymen will not deem useless or unwelcome an attempt to explain, in clear and simple language, the main principles of the system of laws to which their attention is ever more and more directed. Much of the information contained in the following pages is necessarily drawn - consciously or unconsciously - from the standard text-books which are as familiar to lawyers as they are unknown to laymen; and my indebtedness to the authors and editors of those works is great. The mode in which the information is presented to the reader is my own. For such errors as my work may contain, I must crave the indulgence of those who may detect them. To those among my personal friends - both at the Bar and outside the ranks of the profession - whose ready help and valuable suggestions have been of service to me, I take this opportunity of tendering my thanks.
