Diante da indiscutível crise que o Brasil vivencia na efetivação da democracia representativa e dos constantes desnivelamentos no exercício dos poderes instituídos, quais medidas sociais, políticas e jurídicas podem ser implementadas com o objetivo de que as aspirações da sociedade civil sejam alcançadas? O crepúsculo pelo qual os partidos políticos atualmente caminham encontra justificativa em um passado não tão remoto e que percorre desde a hipertrofia institucional destas entidades políticas até o seu quase esvaziamento como instrumento capaz de refletir o verdadeiro anseio da população. Forçoso, pois, reconhecer a necessidade premente de se buscar mecanismos legítimos que permitam a reestruturação da democracia representativa, a fim de se abrandar o hiato ainda existente entre a práxis dos governantes e as pretensões dos governados. De outro lado, observa-se considerável deslocamento de questões políticas diversas, que, primordialmente, eram objeto de trato institucional nos Poderes Executivo e Legislativo, desaguaram no Poder Judiciário, locus nem sempre mais adequado para o trato de determinadas temáticas no âmbito das políticas públicas. Sob este prisma, de igual modo, relevante reconhecer a necessidade de se implementar e aprimorar mecanismos institucionais mais adequados que assegurem a participação da sociedade civil em uma arena ainda hermética e, no momento, hipertrofiada, bem como que possam promover melhor relação dialógica entre os poderes da república.

Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles – written and unwritten – that represent the common heritage of the constitutions of the Member States. This book critically and comparatively examines the responses of the United Nations and a range of countries to the terror attacks on September 11, 2001. It assesses the convergence between the responses of Western democracies including the United States, the United Kingdom, Australia and Canada with countries with more experience with terrorism including Egypt, Syria, Israel, Singapore and Indonesia. A number of common themes - the use of criminal law and immigration law, the regulation of speech associated with terrorism, the review of the state's whole of government counter-terrorism activities, and the development of national security policies - are discussed. The book provides a critical take on how the United Nations promoted terrorism financing laws and listing processes and the regulation of speech associated with terrorism but failed to agree on a definition of terrorism or the importance of respecting human rights while combating terrorism.
