This paper presents the Government's proposals on party funding, which follow the broad approach outlined by Sir Hayden Phillips in his report "Strengthening democracy: fair and sustainable funding of political parties" (2007, ISBN 9780108507113). It also takes account of the Constitutional Affairs Committee report "Party funding: first report of session 2006-07" (HC 163-I, ISBN 9780215031853) and the Committee on Standards in Public Life's (CSPL) "Review of the Electoral Commission" (Cm. 7006, ISBN 9780101700627). The Government proposes: to clarify the Electoral Commission's role as an effective regulator of party funding and campaign expenditure; to provide it with a widened range of sanctions and investigatory powers and to change the various bars and rules on the appointment of Commissioners and recruitment of staff if they have recently been involved in political activity; to increase the number of Commissioners to ten. The Government also agrees with the CSPL recommendation that responsibility for setting electoral boundaries should be removed from the Commission and the Boundary Committee for England should become an independent body. It is widely agreed that perceived 'excessive' spending by political parties is a cause of public concern, and the Government will update and broaden the definition of campaign spending, and aim for the agreement of all parties based on Sir Hayden's package of proposals for comprehensive spending limits. The paper also reviews the case for a donation cap and public funding of political parties. A cap of £50,000 had been suggested by Sir Hayden, but the Government believes a lower limit would be appropriate. Greater transparency on donations is essential. On public funding, the Government acknowledges the wide differences of opinion on how best to achieve reform, and does not intend to legislate until some consensus is reached with all parties.

Political parties are key institutions in any system of representative democracy but the Committee finds that the present system of party financing in the UK is unstable. The report outlines the case for their renewal as a vehicle for the promotion of democratic engagement, including the strengthening of the Electoral Commission and the development of a robust regulatory framework as a starting point for a new funding regime. It also considers the arguments in favour and against caps on expenditure, caps on income and the extension of state funding. Findings include that a package of proposals is required: to contain the growth of and, where possible, reduce the amount of money in the system; to eradicate the possibility of buying political influence; and to guarantee an appropriate level of funding to enable political parties to function. It argues that an increase in state funding for political parties should only follow an agreed and comprehensive framework for the limitation of expenditure and donations. It recommends that any proposed extension of state funding in the UK should seek to achieve consensus amongst the political parties; encourage broad public acceptance of any scheme and support transparent and robust regulatory arrangements. It should be workable, focused towards the local level and should be based on the principle that the main purpose of political parties is to be a vehicle for public activism and engagement. As it would be unrealistic to expect the parties to complete the changes immediately, the Committee recommends a transition period to enable parties to adjust and minimise the scope for a financial disadvantage.

The Committee on Standards in Public Life spent a year looking at party political finance. The majority report believes that the only safe way to remove big money from party funding is to put a cap on donations from all sources, individuals and organisations, of £10,000 in any one year. Trade union affiliation fees could be regarded as a collection of individual donations providing the members individually opt-in to the fee. The cap would have a significant impact on the income of the major parties, and would inevitably require a compensating increase in support for parties from public funds. The public funding should depend on the number of votes secured in the previous election, at the rate of £3.00 a vote in Westminster elections and £1.50 a vote in devolved and European elections. This proposal would result in an annual support amount of some £23 million, equivalent to about 50p per elector per year. Income tax relief, similar to Gift Aid, should be available on donations of up to £1000 and on membership fees to political parties. Another main recommendation, among the 24 in the report, is that the existing limits on campaign spending in the period before an election should be cut by the order of 15 per cent. The proposals will create challenges for the Electoral Commission, and the Committee suggests the recommendations are implemented in time for the start of the next Parliament in 2015. Two members representing political parties dissented from some of the recommendations.
