Excerpt from Patent Office Papers As to the authority of the Commissioner with the ap proval of the Secretary of the Interior to make such a rule there would appear to be little doubt. The rule would be one of expediency, and would be analogous to Rule 42, which provides for the division of an application when two or more independent inventions are presented, or to Rule 36, which requires specifications and drawings to be restricted to the invention, which means the elimination of modifications not covered by any claim. If the office under Ex parte Eagle may limit the number of modifications which may be specifically claimed, if under Rule 42, it may limit the number of inventions, which may be claimed in a single application, and if under Rule 36, it may require the cancellation of figures or sheets of drawings not covered by the claim, it would also appear to have authority to restrict to a reasonable number the modifications or species by which an appli cant seeks to illustrate his invention. Excerpt from Patents and the Preparation and Prosecution of Applications by Applicants Themselves: A Paper Read March 8, 1917, Before the Examining Corps of the United States Patent Office A patent is a Government grant to an inventor, securing to him for the period of seventeen years the exclusive privilege of making, using and vending and of authorizing others to make, use and vend, any new and useful art, machine, manufacture, or composition of matter, or any new and useful improvement thereof. Patents are also granted for designs but this paper is restricted to the consideration of only such patents as are referred to in the definition just stated. According to Walker on Patents, 4th Edition, paragraph 172: "Letters-Patent are documents consisting of the grant and the specification; and where drawings form a part of the application, they also form a part of the letters-patent. The grant is a paper, issued in the name of the United States, under the seal of the Patent Office, and signed by the Commissioner of Patents. It contains a short title of the invention, and purports to grant to the patentee, his heirs or assigns, for the term of seventeen years, the exclusive right to make, use and vend the invention, throughout the United States and the territories thereof; and it refers to the specification for the particulars of the invention covered by the grant, and each of the three rights granted by letters-patent is a separate substantive right." Excerpt from Practice Before the Comptroller of Patents Comptroller-General of Patents' report for the year 1910 shews that in the year 1909-1910 there were 30,603 applications for patents, and 2,829 applications for patents under the International Convention. In the same year there were 1, 005 hearings to meet Office objections to acceptance; and also 4,511 hearings in opposition, revocation, amendment, and other cases fixed, of which 2,320 were heard. It is apparent, therefore, that there is a very large practice at the Patent Office and before the Comptroller. Information on the details of and precedents for this practice have had hitherto to be sought in official documents and works treating generally of patent law, which latter are to a great extent necessarily occupied with the action for Infringement and other actions in the High Court. It was therefore thought that a book which dealt in detail and completely with this practice only would be useful. This book is written with the object of fulfilling this want, and it is intended in it to treat of Patent Office practice exclusively and in greater detail than has before been done. To this end all the reported cases which have come before the Comptroller or Law Officer since 1883 are discussed in the following pages, save a small number which were found to be entirely unimportant.
