La patria potestad se puede definir como el poder que la ley otorga a los padres sobre los hijos menores de edad no emancipados para proveer a su asistencia integral. De todos modos ha de tenerse presente que la patria potestad no solo cubre las necesidades jurídicas del menor sino, también, sus aspectos personales y patrimoniales. Por esta razón la doctrina más moderna la define como el poder global que la ley otorga a los padres sobre los hijos. No es sencilla la concreción del entramado jurídico subyacente a las relaciones paterno-filiales al implicarse, al mismo tiempo, aspectos públicos y privados, tan propios del Derecho de Familia, junto con elementos emocionales e intuitivos de compleja percepción y determinación por el ordenamiento jurídico. Estos aspectos públicos y privados se dejan sentir, de manera particular, en las relaciones paterno-filiales y en la institución de la patria potestad. Tal como indica el TS la patria potestad es un efecto legal propio de toda relación paterno o materno filial, de manera que una vez que queda determinada la filiación, la patria potestad corresponde automáticamente, ex lege, al progenitor ya anteriormente determinado. Así pues la patria potestad es uno de los efectos de la filiación. El menor de edad no tiene capacidad de obrar y será el titular o los titulares de la patria potestad quienes actuarán en el mundo jurídico en su nombre como sus representantes legales. Si dicho menor está emancipado tiene capacidad de obrar limitada o restringida y necesita un complemento de capacidad para ciertos negocios jurídicos, que se lo otorgarán los anteriores titulares de la patria potestad.
