Depuis le tournant du siècle, la Suisse, à l’instar des autres pays signataires du Protocole de Kyoto, s’est dotée d’un certain nombre d’outils de fiscalité écologique dans le but de réduire les atteintes à l’environnement, notamment les émissions de gaz à effets de serre. Les paquets de mesures sont multiples, tout comme le sont les acteurs institutionnels ou économiques de leur mise en oeuvre. Dans cette tension complexe entre économie et politique, l’impact des divers instruments de la fiscalité écologique s’avère mitigé : encourageant pour les uns, décevant pour les autres, il peut même devenir dénaturé et pervers lorsque l’instrument permet d’acheter un droit à polluer davantage. Anthropocene is the proposed name for the new geological epoch in which humans have overwhelming impact on planetary processes. This edited volume invites reflection on the meaning and role of law in light of changing planetary realties. Taking the concept of the Anthropocene as a starting point, the contributions to this book address emerging legal issues from a transnational environmental law perspective. How law interacts with, and how law governs, global environmental problems is a challenge that legal scholars have approached with vigour over the last decade. More recently, the concept of the Anthropocene has become a topic that researchers have also begun to grapple with by engaging with disciplines beyond legal scholarship. International organizations are ubiquitous in contemporary Europe and the wider world. This book is the first systematic assessment of the interactions of the European Communities (EC) with other Western organizations like NATO, the OECD and the Council of Europe for the period from the late 1960s to the early 1990s. Based on fresh archival research, its various contributions explore forms of co-operation and competition between these forums and thus seek to ‘provincialize’ and ‘de-centre’ the role of the predecessors of today’s European Union. Drawing on examples from a diverse set of policy fields including human rights, the environment, security, culture and regional policy, the book argues that inter-organizational dynamics are crucial to understand why the EC became increasingly hegemonic among the organizations active in governing Europe.
