In this powerful debut novel from one of the most gifted storytellers to emerge from Canada since Carol Shields, we find "all the old-fashioned virtues: a vivid sense of place, an intricate and suspenseful plot, and a feisty heroine whom we can't help rooting for on every page" (Margot Livesey). Kit Pitman is fourteen and lives in a ramshackle cottage on the outer banks of Newfoundland, where isolation is all she knows. The only visitors are fogbound fishermen and an occasional young man brought ashore to keep the bloodlines clean. But Kit's isolation is compounded by the mystery that surrounds her family and her illegitimate birth. Her mother, Josie, is mentally retarded and often runs wild among the clapboard houses that dot the shore. Meanwhile, her grandmother Lizzie staunchly guards them both from the disapproving glances pious townsfolk cast their way. But when Lizzie dies suddenly, Kit and her childlike mother are left vulnerable to life's harsh realities and to unexpected dangers that repeatedly threaten to break them apart. A wrenching story ensues, as Morrissey depicts with exceptional grace the way the lines between mother and daughter in this unlikely relationship, although blurred, are deeply felt. KIT'S LAW is a novel of extraordinary, almost mythical power and marks the debut of an enormous new talent.

Peter Birks's tragically early death, and his immense influence around the world, led immediately to the call for a volume of essays in his honour by scholars who had known him as a colleague, teacher and friend. One such volume, published in 2006, contained essays largely from scholars working in England (Mapping the Law: Essays in Memory of Peter Birks, edited by Andrew Burrows and Lord Rodger). This volume contains the essays of those outside England who chose to honour Peter, and appears later than the English volume, reflecting the far flung habitations of its authors. The essays contained in this volume are focussed around the law of unjust enrichment, but are not narrowly preoccupied - instead they move freely from unjust enrichment to some of the most profound questions in private law concerning taxonomy, the relationship between contract, property and unjust enrichment, and the place of remedies within private law. This volume, featuring the work of some of the world's great private lawyers, provides a fitting tribute to a great scholar, and a series of thought-provoking essays inspired by his example. This edited collection brings together leading scholars and practitioners from various jurisdictions with essays and commentaries co-ordinated around the theme of alignments and misalignments between commercial law and commercial practice. The purpose of the book is to prompt a more critical and constructive reassessment of current commercial law and its practices, and to instigate a more fruitful dialogue between academics, judges, law reformers and practitioners. The result is a series of provocative and challenging essays addressing an enormous range of problems that are of intimate concern to commercial practice. Some essays focus on broad themes, such as globalization and trust. Others address more specific issues, such as contract interpretation or constraining modern management. Yet another group targets special problems, such as dematerialisation or super-priority, in order to assess the success of commercial law in meeting commercial demands. The depth and breadth of issues addressed is a credit to the authors. Taken as a whole, the volume makes some pointed suggestions for improving the practices and processes, and indeed the future progress, of commercial law.

Marriage Law And Practice In The Long Eighteenth Century written by Rebecca Probert and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-07-02 with History categories.

This book uses a wide range of primary sources - legal, literary and demographic - to provide a radical reassessment of eighteenth-century marriage. It disproves the widespread assumption that couples married simply by exchanging consent, demonstrating that such exchanges were regarded merely as contracts to marry and that marriage in church was almost universal outside London. It shows how the Clandestine Marriages Act of 1753 was primarily intended to prevent clergymen operating out of London's Fleet prison from conducting marriages, and that it was successful in so doing. It also refutes the idea that the 1753 Act was harsh or strictly interpreted, illustrating the courts' pragmatic approach. Finally, it establishes that only a few non-Anglicans married according to their own rites before the Act; while afterwards most - save the exempted Quakers and Jews - similarly married in church. In short, eighteenth-century couples complied with whatever the law required for a valid marriage.
