Buku ini merupakan lahir dari penelitian. Ya, buku ini lahir dari embrio disertasi bertajuk “Sengketa Kewenangan Lembaga Negara dalam Penerapan Sistem Bikameral di Indonesia Studi terhadap Sengketa Kewenangan DPD-RI (DPD) dengan DPR-RI (DPR) dalam Pelaksanaan Fungsi Legislasi”. Penulis mengucapkan terima kasih kepada pihak yang mengantarkan riset ini menjadi sebuah buku. Disusun berdasarkan pengalaman empiris bekerja di DPR maupun DPD dan merasakan suasana kebatinan yang timbul dalam dinamika hubungan kedua lembaga dalam pelaksanaan tugas, fungsi dan kewenangannya terutama pada fungsi legislasi. Sebagai sebuah refleksi empiris yang berada dalam dua lembaga tersebut, bahan terakhir penulis menjadi anggota DPD sehingga dapat menjadi rujukan dalam memahami relasi DPD dengan DPR dalam kurun waktu dulu, kini, dank ke depan. Secara teoretis, diharapkan buku ini dapat meberikan kegunaan bagi pengembangan teori ilmu hukum, khususnya hukum tata negara, yaitu berupa kerangka teoritik hubungan lembaga negara dan sengketa lembaga negara khususnya dalam pelaksanaan fungsi legislasi pada parlemen yang menggunakan sistem bikameral. Secara praktis diharapkan memberikan sumbangan bagi perbaikan penanganan sengketa lembaga negara dan pelaksanaan fungsi legislasi yang melibatkan DPD dan DPR, agar dapat berjalan secara sinergis dan pada giliranya akan mampu meningkatkan kinerja legislasi dalam kerangka penerapan sistem bikameral. Penelitian dan penulisan buku hasil riset ini menggunakan paradigma konstruktif. Menurut Thomas S. Kun,[1] paradigma ilmiah adalah contoh-contoh praktik ilmiah yang aktual dan dapat diterima. Contoh tersebut mencakup undang-undang, teori, penerapan, dan instrumentasi secara bersama-memberikan model yang darinya timbul tradisi penelitian ilmiah khusus yang koheran. Paradigma adalah cara kita memahami kehidupan, seperti air bagi ikan. Paradigma menjelaskan kehidupan ini kepada kita dan memudahkan kita untuk mengira-ngira perilakunya. Dalam pemahaman yang lain menegaskan bahwa paradigma adalah kerangka kerja dari pikiran, skema untuk memahami dan menjelaskan aspek tertentu dari kehidupan ini. Pengertian paradigma juga dimaknai sebagai seperangkat kepercayaan atau keyakinan dasar yang menuntun seseorang dalam bertindak dalam kehidupan sehari-hari maupun dalam penyelidikan ilmiah.[2] Kaum konstruktivisme berpendirian bahwa manusia pada dasarnya mengkonstruksi dan memodifikasi konsep, model, realitas, termasuk pengetahuan dan kebenaran hukum. Dalam mengembangkan suatu paradigma khususnya paradigma konstruktif harus didasarkan pada aspek filosofi dan metodologis yang meliputi dimensi:[3] Ontologis, yaitu realitas merupakan konstruksi sosial, kebenaran suatu realitas bersifat relatif, berlaku sesuai kontek spesifik yang dinilai relevan pelaku sosial. Epistemologis, yaitu transaksional/subjektif : Pemahaman tentang suatu realitas, atau temuan suatu penelitian merupakan produk interaksi antara yang meneliti dan yang diteliti. Metodologis, terutama pendekatan reflective/dialectical menekankan empati dan intraksi dialektik antara peneliti-responden untuk merekonstruksi realitas diteliti melalui metode-metode kualitatif.
