Setelah disahkannya UU No. 21 Tahun 2007, penanggulangan tindak pidana perdagangan manusia dapat menjadi jawaban atas tindakan buruk terhadap pengebirian harkat dan martabat manusia khususnya yang kerap terjadi di Indonesia. Penyelesaian perkara dengan konsep Diversi melalui pendekatan konsep Keadilan Restoratif pada hakikatnya telah dikenal dan dipraktikkan di Indonesia. Ruh dari konsep ini adalah musyawarah untuk mencapai mufakat yang melibatkan korban, pelaku dan keluarganya, aparat penegak hukum serta pihak ketiga. Proses musyawarah antara pelaku dan korban dan/atau keluarga korban dilakukan secara bebas dengan prinsip setara dan seimbang sehingga keputusan yang dihasilkan mencerminkan keadilan, kemanfaatan dan kepastian hukum. Terobosan ini, salah satunya, dapat diterapkan pada tindak Pidana terhadap harta benda. Sebab pada hakikatnya, Korban tidak menginginkan pelaku dihukum (dipenjara) tetapi bagaimana kerugiannya dipulihkan atau kerugiannya dikembalikan oleh pelaku dan pelaku harus meminta maaf dan mendapatkan maaf dari korban. Pada prinsipnya, Diversi hanya dikenal dalam Sistem Peradilan Pidana Anak sebagaimana diatur dalam UU Nomor 11 Tahun 2012, belum dikenal dalam tindak Pidana lain. Buku ini akan memberikan pandangan bahwa Diversi dapat diterapkan pada tindak pidana lain terutama untuk tindak pidana terhadap harta benda, dan satu hal yang baru karena belum diatur dalam UU tersendiri tetapi baru diatur dalam tataran diskresi dari masing-masing instansi penegak hukum seperti Peraturan Kepala Kepolisian Nomor 6 Tahun 2019 tentang Penyidikan Tindak Pidana dan Peraturan Kejaksaan Agung Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif.
