This edited volume is the first to focus on how concepts of citizenship diversify and stimulate the long-standing field of law and literature, and vice versa. Building on existing research in law and literature as well as literature and citizenship studies, the collection approaches the triangular relationship between citizenship, law and literature from a variety of disciplinary, conceptual and political perspectives, with particular emphasis on the performative aspect inherent in any type of social expression and cultural artefact. Contemporary Europe – ridden by social, political and economic crises, overlaid onto colonial and imperial trajectories, and shaken by the shockwaves generated by Brexit and wide scale human displacement – has become a space in which citizenship and belonging are contested, disrupted, performed and produced anew. Art, Migration, and the Production of Radical Democratic Citizenshipexplores the contribution of migrant and refugee artists to the performance and production of radical democratic citizenship in Europe. It foregrounds the insights of artists and cultural actors with diverse experiences of migration and displacement to fractious public debates about citizenship and belonging. It explores how migrant and refugee artists have audaciously inserted themselves into, and are pushing the boundaries of these debates, challenging and unhinging dominant interpretations of the parameters of European citizenship and belonging. Part I of this edited volume is comprised of a series of short provocations by artists spanning and intermixing a range of art forms and methodologies including live art, visual art and public installation, community and site-specific durational work, or the combination of writing, auto-ethnography and media activism. The second Part comprises longer, more sustained engagements by visual and live art practitioners, dramaturges, curators and academics. Through a comparative analysis of ten liminal polities - Abkhazia, Kosovo, Nagorno-Karabakh, Somaliland, South Ossetia, Palestine, Taiwan, the Turkish Republic of Northern Cyprus (TRNC), Transnistria and Western Sahara, the paper focuses on the ways in which such polities actively perform statehood and citizenship to compensate for their sovereignty deficit. The paper has a three-fold aim: a) to measure the impact of internal and/or external statehood contestation on the scope of citizenship rights in liminal polities; and b) to demonstrate how such atypical polities represent liminal spaces of citizenship, whose subjects are neither full citizens nor stateless; and c) to analyze the performative role of citizenship and struggles over rights claims in enabling these liminal polities and their citizens to constitute themselves as political subjects - as states and citizens, respectively. It argues that, although statehood contestation and lack of sovereignty have a direct bearing on the scope of citizens' rights, the level of impediment of rights and protection of individuals belonging to such atypical entities is determined by the degree of internal/external contestation as well as the very functionality of the citizenship regime in place.

This book outlines a critical theory of citizenship, with an emphasis on how citizenship institutes power relations and organises the rights and obligations of those who become its subjects. Whether it is the question of the rights of animals, children, migrants, minorities, mothers, or mountains, and whether such rights are protected or guaranteed by national law, international law, or human rights law, the issue of citizenship has already indelibly marked the 21st century. As an institution, citizenship governs the relationship between a polity and its peoples by dividing them into citizens and noncitizens, with differentiated rights and obligations. So necessarily, this book argues, citizenship is an institution of domination and emancipation that brings into play the struggles of those who want to protect certain privileges and the struggles of those who are against being caught in either second-class or noncitizen categories. Deconstructing dominant theories and practices of citizenship, a critical theory of citizenship must, therefore, not only analyse intersecting rights, but also connect citizenship to these broader social struggles. For it is these struggles, the book maintains, that give meaning to citizenship itself. The book will be of interest to scholars and students in sociolegal studies, sociology, politics, and as well as those working in citizenship, migration, and refugee studies.

Transforming Citizenships engages the performativity of citizenship as it relates to transgender individuals and advocacy groups. Instead of reading the law as a set of self-executing discourses, Isaac West takes up transgender rights claims as performative productions of complex legal subjectivities capable of queering accepted understandings of genders, sexualities, and the normative forces of the law. Drawing on an expansive archive, from the correspondence of a transwoman arrested for using a public bathroom in Los Angeles in 1954 to contemporary lobbying efforts of national transgender advocacy organizations, West advances a rethinking of law as capacious rhetorics of citizenship, justice, equality, and freedom. When approached from this perspective, citizenship can be recuperated from its status as the bad object of queer politics to better understand how legal discourses open up sites for identification across identity categories and enable political activities that escape the analytics of heteronormativity and homonationalism.
