Sebelum lahirnya Undang-Undang No 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik, penggunaan media elektronik dalam melakukan transaksi sudah dilakukan di kalangan masyarakat. Hal ini menunjukkan bahwa fungsi hukum sebagai alat rekayasa sosial (the law as a tool of social engineering) perlahan mengalami kemunduruan dan telah diinvasi oleh teknologi. Sehingga hukum harus mengikuti perkembangan teknologi. Dengan adanya kepastian hukum, maka ruang sosial telah terbuka lebih luas melalui proses transaksi elektronik. Tujuan utama yang mendasari inisiatif untuk menulis buku ini karena masih terbatasnya literatur yang membahasan masalah e-commerce baik dari aspek hukum perdata dan aspek hukum pidana. Teknologi sebagai alat yang menawarkan kemudahan dalam dunia e-commerce akan tetapi masih menyisahkan berbagai permasalahan pembuktian, keabsahan transaki elektronik, pengesahan, penyimpanan data elektronik, dan masalah keamanan dalam melakukan transaksi e-commerce.
