En la presente obra se analizan las relaciones entre la familia y la Seguridad Social. Se parte de la premisa fundamental de que la familia, con base en el principio de solidaridad, desarrolla como una de sus funciones esenciales la previsión y satisfacción de las necesidades de sus miembros, constituyendo un núcleo de autoprotección de los riesgos sociales de los mismos. Sin embargo, esta función que históricamente ha cumplido la familia ha sido asumida por el Estado a través, básicamente, de la institución de la Seguridad Social, siendo la razón explicativa de este fenómeno la vinculación que se produce entre dichas instituciones a nivel funcional, dado que ambas se fundamentan en la idea de solidaridad. En esta línea, se parte como causas del intervencionismo público en la protección familiar a través de la Seguridad Social: 1) de la insuficiencia de las instituciones civiles de protección a la familia, basadas en la juridificación del principio de solidaridad familiar y en el principio de subsidiariedad; 2) de la insuficiencia de los instrumentos privados de previsión social y de la beneficencia pública. Tras el análisis histórico de la protección pública a la familia desde la Seguridad Social y su engarce en el marco de las políticas familiares, la siguiente parte del trabajo analiza las técnicas de protección a la familia presentes en nuestro Sistema de Seguridad Social, que presentan distintas articulaciones: 1) como una contingencia protegida, 2) como un colectivo protegido, 3) como un factor de aumento de la cuantía de las prestaciones, 4) como un requisito de acceso a la protección del Sistema, 5) como una garantía establecida en el régimen jurídico general de las prestaciones, y 6) finalmente se hará referencia a la protección a la familia a través de los Servicios Sociales y el Seguro Escolar. Óscar Buenaga Ceballos es Licenciado en Derecho por la Universidad de Cantabria y es abogado en ejercicio del Ilustre Colegio de Abogados de Cantabria desde el año 1992.
