This book presents new research on gender-based violence in Southeast Asia, bringing together varied scholarly work in law, policy, and practice. It enables a greater understanding of violence against women as an international concern, highlighting particular issues that arise in the region. Against a background of international obligations to ensure women's rights through laws and policies that are geared at ending violence against women and girls, this research documents the state failures, individual shame and fear, and societal culture that collectively affects the reporting, investigation, prosecution of perpetrators, and protection of victims. The research explores differing legal mechanisms both internationally, and within nation states, relating to cases of physical and sexual violence. It recognizes the need for functioning mechanisms to ensure women can report their cases safely and be provided with protective and therapeutic services in a way that is systematic, effective, and measurable. Laws and court decisions are analyzed, crisis and safety centers are examined, and in-depth interviews are conducted with actors and NGOs with relevant roles and functions in the mechanism of cases of violence against women. The result is a comprehensive assessment of the incalculable harm it does within Southeast Asian society, and the obstacles it presents for law enforcement. The chapters uncover mechanisms with unique characteristics across Southeast Asia, providing a nuanced understanding of the cultural and social backgrounds, as well as the religious structures, that can both help and hinder suitable frameworks. It is relevant to scholars, policymakers, and practitioners in law, criminology, and gender sociology. “This is a valuable contribution towards empowering the women of South East Asia out of victimhood to valued equality, involvement in governance and leadership through the elimination of violence and discrimination and an excellent resource not just for those working in this field but for those involved in law making, the media and the people of South East Asia.” - Professor Felicity Gerry QC, Barrister at Crockett Chambers Melbourne and Libertas Chambers, London, and Professor of Legal Practice at Deakin University and Honorary Professor at Salford University.

This book explores the intimate marital relationships of Indonesian Muslim married women. As well as describing and analysing their sexual relationships, the book also investigates how Islam influences discourses of sexuality in Indonesia, and in particular how Islamic teachings affect Muslim married women’s perceptions and behaviour in their sexual relationships with their husbands. Based on extensive original research, the book reveals that Muslim women perceive marriage as a social, cultural, and religious obligation that they need to fulfil; that they realise that finding an ideal marriage partner is complicated, with some having the opportunity for a long courtship and others barely knowing their partner prior to marriage; and that there is a strong tendency, with some exceptions, for women to consider a sexual relationship in marriage as their duty and their husband’s right. Religious and cultural discourses justify and support this view and consider refusal a sin (dosa) or taboo (pamali). Both discourses emphasise obedience towards husbands in marriage.

This book examines life trajectories among three categories of women living beyond the bounds of heteronormativity in Jakarta and Delhi, two major cities with substantively different religious and social values: women who have lost their husbands, either through divorce or death; sex workers; and young, urban lesbians. Delhi has a large Hindu majority and a sizeable Muslim minority, amongst other religious and cultural pluralities. The Indian state is constitutionally committed to secularism and equal respect to all regions despite right-wing Hindu fundamentalism. Jakarta is the capital of a sprawling archipelago with a large variety of ethnic cultures, Indonesia having the largest Muslim population of the world, as well as sizeable ethnic and religious minorities comprising Christians, Hindus, Buddhists and others. The Indonesian state is constitutionally secular, but religion plays a large role in public life and is embedded in regulations that strongly impact people's private lives. Recently, there have been strong political currents to impose stricter Islamic codes. The public arena of sexual politics, in which the media play an important role, is explored in both cities. Hot sex is a major media selling point, particularly in Indonesia. Heteronormativity entails a system of symbolic violence in the sense that it punishes those that it excludes and polices those that it includes; the ways its powers are subverted are likewise symbolic. Passionate aesthetics refers to the dynamics, motivations, codes of behavior and presentation, subjectivities and identities that together make up the complex workings of erotic attraction, sexual relations and partnerships patterns. By charting the lives of women who live beyond the boundaries of the heteronormative, commonalities are revealed; boundaries and regulatory mechanisms in the context of symbolic violence are delineated; and the issue of the struggle for sexual rights for marginalised groups, and their open rebellion, brought to the fore. At the heart of the book lies elaboration of the ways Asian families are constructed -- their social, economic, sexual and religious agency, and how these engage with state-led values.
