Maritime piracy off the coast of Somalia was first recognised as a global concern in 2008 after the hijackings of World Food Programme vessels. It remains a serious impediment to international maritime trade and a significant risk to seafarers. Bringing a criminological perspective to the subject, this book presents an analysis of Somali piracy by means of Routine Activity Theory and regulatory pluralism. Based on data from a range of sources, including published documents and in-depth interviews with representatives of industry, government, and international organisations, the study concludes that no one institution or policy will suffice to control Somali piracy. Accordingly, a number of different actors and institutions have a role to play in reducing the supply of motivated offenders, the vulnerability of prospective victims, and in enhancing guardianship. The book envisages a holistic counter-piracy program based on a pluralistic regulatory model that is sustainable within the region, and managed by the region, providing the best opportunity for both the immediate future, and for long-term success. This study will be essential reading for criminologists, public policy and legal scholars, as well as policy makers and regulators in countries affected by and dealing with piracy, and international professional advocacy groups operating in the maritime space.

A couple of weeks ago yet another ship has been captured. According to the International Maritime Organization (IMO) data, there had been more pirate attacks reported in the first quarter of 2009 than in the entire previous year, whereas Somali pirates had undertaken half of those. It seems as if the twenty-first century is competing against the seventeenth. Put differently, combating piracy off the Somali coast might now be considered an analogy to the fight against international terrorism following September 11. Being considered a rather regional problem so far, piracy off the coast of Somalia has taken on international implications since more than 20,000 ships a year are passing Somali waters carrying about 8 % of the world’s trade of goods and commodities. This very important route – through the Gulf of Aden – is threatened continuously by pirates affecting international commercial shipping, fishing and humanitarian aid supply. In the first step this paper will introduce the region as well as the setting of the crisis and offer a pragmatic definition of the act of piracy. Subsequently it will outline the extent to which the crisis causes significant concerns and point out its impact not only on Somalia but also on international trade, the environment and security; altogether stirring vitally important areas of international freedom. In the second step it will cover the actions taken by the international community, especially the United Nations Organizations, and approach proposals to resolve the conflict. The consequential arguments represent the bridging to the third part which will summarize the points at issue and conclude with questions offering incentives to alternative approaches.

Somali piracy poses a threat to the UK's national interests as well as global trading routes and international security. The costs of allowing piracy to proliferate are high. The British shipping industry is worth £10.7 billion to the UK's GDP, and the costs of security, insurance, re-routing have vastly increased the costs of doing business. Over $300 million has been paid in ransoms to Somali pirates over the past four years, and thousands of seafarers have been held hostage, some of whom have been subject to cruel treatment and even torture. Self-defence measures, multi-national naval operations and prosecutions have begun to take effect, but have not yet contained the problem. The major international conference on Somalia in February 2012 must produce results. Although private armed guards will be permitted on UK shipping, the Government's guidance on the use of force, particularly lethal force, is very limited and there is little to help a ship's master make a judgement on where force can be used. The Committee also expresses surprise that so little is known about what happens to ransom money. The solution lies in establishing order on land, ending impunity for piracy crimes and offering alternatives. However, the report warns against international claims to deliver a solution in Somalia, and urges the Government to develop its engagement with and support for Somali civil society organisations and local projects. The FCO should also review its communication and other procedures to support family members of British hostages held abroad.

UN Secretary general Ban Ki Moon warned in November 2012 that despite the sharp decline in piracy attacks, progress was fragile and "easily reversed if we do not address the causes of piracy". The efforts of the international community to combat piracy by patrolling the waters off the Horn of Africa and prosecuting pirates have reduced piracy to some degree. However, piracy persists due to its extremely high returns. Because Somalia has been a failed state for decades without functioning institutions, it is easy for pirate money to be transferred and laundered. Somali pirates have managed to establish a unique business model: vessels of all kinds are being hijacked with their crews on board for the sole purpose of gaining ransom, which is estimated to have resulted in over $290 million being paid to Somali pirates between 2007 and 2012. The conditions in Somalia permit undetected money flow in the investments of the financiers and the reinvestment of ransom money to purchase weapons and other gear for future piracy missions. The economic factor has existed through the centuries and will remain the common denominator for Piracy. The initial inputs are minuscule when compared with the financial returns. Thus, identifying the pirate lords and other financiers who sponsor piracy is vital to deterring piracy. The paper goes on to examine the phenomenon of Piracy as a whole; to identify meanings and establish why it is a very profitable business for pirates but also for insurers and bankers, contributing greatly to the instability of the Country and the region. The research also covers the link between ransoms and investments. Increasingly high ransoms nourish piracy and profit coming from the investment of proceeds creates income for local communities, communities living abroad, negotiators, investors and supporters. The paper concludes that curbing financial resources to pirates will help to rapidly extinguish the vital core of the business and a solution will be proposed to minimize the problem.
