Media Piracy in Emerging Economies is the first independent, large-scale study of music, film and software piracy in emerging economies, with a focus on Brazil, India, Russia, South Africa, Mexico and Bolivia. Based on three years of work by some thirty five researchers, Media Piracy in Emerging Economies tells two overarching stories: one tracing the explosive growth of piracy as digital technologies became cheap and ubiquitous around the world, and another following the growth of industry lobbies that have reshaped laws and law enforcement around copyright protection. The report argues that these efforts have largely failed, and that the problem of piracy is better conceived as a failure of affordable access to media in legal markets.

Usually, we look at media consumption starting from a media industry definition. We look at TV, radio, newspapers, games, Internet, and media content in general, all departing from the idea that the access to such content is made available through the payment of a license fee or subscription, or simply because its either paid or available for free (being supported by advertisements or under a "freemium" business model). That is, we look at content and the way people interact with it within a given system of thought that sees content and its distribution channels as the product of relationships between media companies, organizations, and individualseffectively, a commercial relationship of a contractual kind, with accordant rights and obligations. But what if, for a moment, we turned our attention to the empirical evidence of media consumption practice, not just in Asia, Africa, and South America, but also all over Europe and North America? All over the world, we are witnessing a growing number of people building media relationships outside those institutionalized sets of rules. We do not intend to discuss whether we are dealing with legal or illegal practices; our launching point for this analysis is that, when a very significant proportion of the population is building its mediation through alternative channels of obtaining content, such behavior should be studied in order to deepen our knowledge of media cultures. Because we need a title to characterize those cultures in all their diversitybut at the same time, in their commonplacenesswe propose to call it "Piracy Cultures."

In this thesis, I undertake a positive analysis of digital media piracy to examine the movement's authorial capacities. Proposed by James Meese as a way of looking beyond the traditional "piracy is theft" framework, this perspective offers new insights about how the increasingly mundane act of downloading and sharing media files can incite social change. I begin by examining what it means to be a digital media pirate, and how that question is part of the construction of the piracy movement. In the second chapter, I explore the complex relationship between piracy and information capitalism, highlighting how piracy arises from within information capitalism. In the third chapter, I look to how moral panic discourse has been used to demonize pirates, but also how this process has been appropriated by pirates to circulate counter-hegemonic discourse. In the fourth chapter, I examine how pirates are the authors of alternative ethical criteria within private filesharing communities, and how pirates mobilize moral and ethical discourse to push back against attempts to impede their ability to pursue a good piratical life. The final chapter of this thesis takes up the ethnographically rich moment of the Kickass Torrents shutdown in July 2016. Looking at the shut down as an event that like digital media piracy is both meaningful yet mundane, we see how pirates, though contesting romanticized and naturalized norms of property and authorship, push for a new form of authorship constituted by p2p communication in online spaces. Through these perspectives on the piracy movement in the summer of 2016, I argue that through the agglomerated effects of individual acts of piracy, the broader piracy movement radically changes the ways we understand and engage with cultural media objects.

Therefore, it will be examined what kind of measures are available at the judicative and the legislative stage. In particular the essay refers to the unauthorised exploitation of music within the Internet. After an introduction into the topic of digital piracy and music, a brief historical overview gives an insight of certain technologies that were/are found to be infringing. Further contemporary forms of digital piracy are explained, as the peer-to-peer networks, which are a major threat to the industry. On the example of important cases of music piracy it will be shown how courts struggled with that topic. As this essay is mainly focused on the UK, the cases of Newzbin and Newzbin2 will be examined in detail, as those show important developments in both subsuming online piracy and enforcement. The legislative perspective will be examined on the example of three strike laws, which provide the so-called graduate response- an alternative way to litigation. It will be demonstrated on the examples of the UK’s Digital Economy Act and the French HADOPI law what new measures are provided and how they are operated. This will be followed by a conclusion containing the personal opinion of the author.

Much of what we think we know about how the internet "disrupted" media industries is wrong. Piracy did not wreck the recording industry, Netflix isn't killing Hollywood movies, and information does not want to be free. In Media Disrupted, Amanda Lotz looks at what really happened when the recorded music, newspaper, film, and television industries were the ground zero of digital disruption. It's not that digital technologies introduced "new media," Lotz explains; rather, they offered existing media new tools for reaching people. For example, the MP3 unbundled recorded music; as the internet enabled new ways for people to experience and pay for music, the primary source of revenue for the recorded music industry shifted from selling music to licensing it. Cable television providers, written off as predigital dinosaurs, became the dominant internet service providers. News organizations struggled to remake businesses in the face of steep declines in advertiser spending, while the film industry split its business among movies that compelled people to go to theaters and others that are better suited for streaming. Lotz looks in detail at how and why internet distribution disrupted each industry. The stories of business transformation she tells offer lessons for surviving and even thriving in the face of epoch-making technological change.
