Barbara Böckenförde-Wunderlich befaßt sich mit der rechtlichen Würdigung der Präimplantationsdiagnostik (PID), einem Untersuchungsverfahren zur Erkennung genetischer Defekte und Chromosomenaberrationen am künstlich erzeugten Embryo. Die Autorin geht zunächst auf die Rechtslage in Großbritannien ein. Hier wurde bereits 1990 ein Gesetz erlassen, das den neuen Möglichkeiten der Reproduktionsmedizin aufgeschlossen gegenübersteht. Die Rechtslage in Deutschland wird im Hinblick auf das ärztliche Ethos und die kodifizierten Standesregeln der Ärzte untersucht. Außerdem wird die Vereinbarkeit der PID mit der derzeitigen Fassung des Embryonenschutzgesetzes erörtert. Die verfassungsrechtliche Würdigung der Präimplantationsdiagnostik bildet einen Schwerpunkt der Untersuchung.

Die Verwirklichung des Prinzips der Nachhaltigkeit sieht sich durch die Spielregeln des parteidemokratischen Prozesses erheblichen Schwierigkeiten gegenuber. Christoph Popp untersucht, ob direktdemokratische Verfahren diesen Problemen Abhilfe leisten konnen. Der dahinterstehenden Frage der Nachhaltigkeitsaffinitat der Entscheidungen seitens der Burger geht der Autor durch eine umfassende empirische Analyse auf Landes- und Kommunalebene nach. Neben einer Einzelfalluntersuchung unterzieht er dazu alle nachhaltigkeitsrelevanten Burgerentscheide im Zeitraum von 2007 bis 2017 einer systematischen Auswertung. Darauf aufbauend und mithilfe von sozialpsychologischen und -biologischen Erklarungsansatzen des Abstimmungsverhaltens entwickelt er abschliessend einen Vorschlag fur eine Verfassungsausgestaltung, der die direkte Demokratie auf Bundesebene moglichst nachhaltigkeitswirksam implementieren wurde.

This book proposes a holistic transdisciplinary approach to sustainability as a subject of social sciences. At the same time, this approach shows new ways, as perspectives of philosophy, political science, law, economics, sociology, cultural studies and others are here no longer regarded separately. Instead, integrated perspectives on the key issues are carved out: Perspectives on conditions of transformation to sustainability, on key instruments and the normative questions. This allows for a concise answer to urgent and controversial questions such as the following: Is the EU an environmental pioneer? Is it possible to achieve sustainability by purely technical means? If not: will that mean to end of the growth society? How to deal with the follow-up problems? How will societal change be successful? Are political power and capitalism the main barriers to sustainability? What is the role of emotions and conceptions of normality in the transformation process? To which degree are rebound and shifting effects the reason why sustainability politics fail? How much climate protection can be claimed ethically and legally e.g. on grounds of human rights? This book shows how the legal systems of individual European countries protect patient autonomy. In particular, it explains the role of criminal law, that is, what criminal law protection of patient autonomy looks like on a European scale in both legal and social dimensions. Despite EU integration processes, the work illustrates that the legal orders of individual European countries are far from uniform in this area. The concept of patient autonomy here is generally in the context of the patient's freedom from unwanted medical activities: the so-called negative freedom. At the same time, in countries where there are no regulations clearly criminalising the performance of a therapeutic activity without the patient's consent, the so-called positive freedom is also discussed.
