Die zweckrationale Überlegenheit und die wertbezogenen Vorzüge pluralisti scher Verfassungs- und Gesellschaftsordnungen sollten im Ausgang des 20. Jahrhunderts aus geschichtlichen Erfahrungen und vernunftsfähiger Argumen tation kaum noch prinzipiell in Zweifel gezogen werden; der gleichermaßen funktionale wie moralische Bankrott antipluralistischer Gegenentwürfe eines to talitär-diktatorischen, autoritär-zentralistischen oder doktrinär-fundamentalisti schen Politikmodells ist allseits offenkundig. Aber auch Einseitigkeit und Ver engungen im Rahmen eines pluralistischen Konzepts der politischen Kultur einer offenen Gesellschaft - nicht selten mit vorsorglicher Abwehr ihrer äuße ren und inneren Gefährdungen legitimiert - haben sich letztlich nicht bewährt: Weder ein wohlfahrtsstaatliche Regulative ignorierender Marktradikalismus noch überzogene nationale und internationale Sicherheitsdoktrinen - um hier nur diese Beispiele zu nennen -konnten ihre propagierten Ziele ohne zumindest gravierende soziale Kosten erreichen. Nicht nur "gemischte" Verfassungsele mente und "mixed economies" erweisen sich gegenüber monistischen Perspek tiven als flexibler und entwicklungsfähiger; auch die zunehmende Komplexität der Gesellschaft und die wachsende Vielfalt der Lebensstile lassen das "Projekt der Moderne" mit einem umfassenden Pluralitätsverständnis zusammenfließen, dem anstelle irgendwelcher Patentrezepte nur "mixed policies" und zugleich "mixed cultures" auf der Basis des Denkens und Argumentierens in jeweils möglichst "fehlerfreundlich " korrigierbaren und situationsadäquat wahrzuneh menden Optionen annähernd gerecht zu werden versprechen.

The Weimar Republic – from 1919 until 1933, when Hitler came into power – witnessed crucial debates on law and politics. These debates are reexamined in this book. Were, for example, democratic rules and procedures an adequate basis for democracy, as Hugo Preuss and Hans Kelsen suggested? Or should constitutional law elaborate the deeper, basic principles embedded in the democratic constitution itself, as Hermann Heller argued? Was the president the immediate “guardian of the constitution”, as Carl Schmitt’s concept of “representation” suggested? Or was Schmitt’s concept itself subject to Walter Benjamin’s critique of the aura of authenticity? These, and other typical Weimar-era debates helped shape West German constitutionalism. The former labor lawyer on the left Ernst Fraenkel, for example, began to develop a general theory of dictatorship mass democracy while in exile, which influenced the new discipline of political science after the war. Similarly, Gerhard Leibholz, an anti-positivist lawyer in Weimar, served on the first Constitutional Court of the Federal Republic of Germany, helping to consolidate its new constitutional culture.

In the spring of 1933, German society was deeply divided – in the Reichstag elections on 5 March, only a small percentage voted for Hitler. Yet, once he seized power, his creation of a socially inclusive Volksgemeinschaft, promising equality, economic prosperity and the restoration of honor and pride after the humiliating ending of World War I persuaded many Germans to support him and to shut their eyes to dictatorial coercion, concentration camps, secret state police, and the exclusion of large sections of the population. The author argues however, that the everyday practice of exclusion changed German society itself: bureaucratic discrimination and violent anti-Jewish actions destroyed the civil and constitutional order and transformed the German nation into an aggressive and racist society. Based on rich source material, this book offers one of the most comprehensive accounts of this transformation as it traces continuities and discontinuities and the replacement of a legal order with a violent one, the extent of which may not have been intended by those involved.

Historians of the stabilization phase of Weimar Germany tend to identify German recovery after the First World War with the struggle to revise reparations and control hyperinflation. Focusing primarily on economic aspects is not sufficient, however, the author argues; the financial burden of recovery was only one of several major causes of reaction against the republic. Drawing on material from major German cities, he is able to trace the emergence of strong local activism and of comprehensive and functional policies of recovery on the municipal level which enjoyed broad political backing. Ironically, these same programs that created consensus also contained the potential for destabilization: they unleashed intense debate over the needs of the consumersand the purpose and extent of public spending, and with that of government intervention more generally, which accelerated the fragmentation of bourgeois politics, leading to the final destruction of the Weimar Republic.

Across the modern era, the traditional stereotype of Germans as authoritarian and subservient has faded, as they have become (mostly) model democrats. This book, for the first time, examines 130 years of history to comprehensively address the central questions of German democratization: How and why did this process occur? What has democracy meant to various Germans? And how stable is their, or indeed anyone's, democracy? Looking at six German regimes across thirteen decades, this study enables you to see how and why some Germans have always chosen to be politically active (even under dictatorships); the enormous range of conceptions of political culture and democracy they have held; and how interactions among various factors undercut or facilitated democracy at different times. Michael L. Hughes also makes clear that recent surges of support for 'populism' and 'authoritarianism' have not come out of nowhere but are inherent in long-standing contestations about democracy and political citizenship. Hughes argues that democracy – in Germany or elsewhere – cannot be a story of adversity overcome which culminates in a happy ending; it is an ongoing, open-ended process whose ultimate outcome remains uncertain.
