En este libro se cuestionan los conceptos de poder constituyente, los derechos humanos, el delito de genocidio de los pueblos indígenas, el constitucionalismo de los Estados de derecho y lo común. Se hace desde miradas y perspectivas que recuperan otros horizontes y otros significados muy diferentes a lo establecido por la cultura jurídica y política oficial. Se rebelan contra posiciones e imaginarios cuyo principal objetivo es establecer e imponer una visión hegemónica y homogénea de lo humano, que en el fondo es excluyente y no incluyente e inculca una cultura dormida, conformista, resignada e indolente en relación a la lucha por la justicia social. El común denominador de todos los trabajos se sintetiza en dos planos: 1) se basan en perspectivas críticas que tienen una fuerte influencia del pensamiento de liberación latinoamericano y del pensamiento de-colonial. Tratan de descentrar el eurocentrismo y el occidentalismo dominante, recuperando tradiciones que luchan por procesos que permitan la emancipación y la liberación incluyente, instituyente y contra-opresiva con las que se posibilite a todo ser humano una vida digna de ser vivida; 2) todos los enfoques apuestan por reivindicar y recuperar la riqueza de lo humano que se expresa en su pluralidad, su diversidad y en un profundo carácter multicultural. La fuente principal es el poder popular del bloque social de los oprimidos. Lo intercultural se estructura sobre el reconocimiento de sociabilidades horizontales que rechazan cualquier tipo de odios y fundamentalismos y que caminan desde experiencias no discriminatorias, abiertas a la alteridad, no coloniales, no excluyentes y articuladas por medio de la fraternidad, la ética colaborativa y los reconocimientos mutuos.

Este libro se adentra en el estudio de distintas cuestiones que inciden en el efectivo goce de los derechos de los pueblos indígenas y tribales en la región latinoamericana. En primer término se presentan al lector algunas reflexiones sobre la evolución del reconocimiento de tales derechos, partiendo de un claro análisis en torno a los criterios hasta ahora desarrollados por la Comisión y la Corte Interamericana de Derechos Humanos. Enseguida, los autores pretenden describir el fundamento jurídico y proponer un fundamento ético para el ejercicio diferenciado de derechos por parte de dichos pueblos y su colisión con el interés de los Estados, analizando además la evolución del derecho constitucional indigenista en América Latina, que ha permitido el surgimiento de marcos constitucionales ajustados a sociedades pluriculturales que –en ciertos casos– permiten la consagración de la consulta previa. Asimismo se analiza el tema de la justiciabilidad de los derechos económicos, sociales, culturales y ambientales de los pueblos indígenas y tribales vinculados con la propiedad territorial en la jurisprudencia de la Corte Interamericana; para concluir con contrastantes reflexiones acerca de la implementación de proyectos de extracción, inversión o desarrollo que impactan en sus vidas. Constitutional reform has been one of the most significant aspects of democratization in late twentieth century Latin America. In The Friendly Liquidation of the Past—one of the first texts to examine this issue comprehensively —Van Cott focuses on the efforts of Bolivia and Colombia to incorporate ethnic rights into their fragile democracies. In the1990s, political leaders and social movements in Bolivia and Colombia expressed dissatisfaction with the quality of democracy--its exclusionary nature, the distance and illegitimacy of the state, and the empty promise of citizenship. The highly symbolic act of constitution making elevated a public struggle for rights to the level of a discussion on the meaning of democracy and the nature of the state. Based on interviews with more than 100 participants in the reforms, Van Cott demonstrates how issues promoted by social movements—recognizing ethnic diversity, expanding political participation and improving representation, and creating spheres of cultural and territorial autonomy—were placed on the constitutional reform agenda and transformed through strategic interaction with political power-brokers into the nation’s highest law. The analysis follows each reform through five years of implementation to assess the early results of what Van Cott suggests is an emerging regional model of multicultural constitutionalism. The Friendly Liquidation of the Past fills an important gap in the study of ethnic politics and constitutional reform in the Andes, linking the literature on institutions and political reform to work in political theory on participatory democracy and multiculturalism.

In 1990, when Augusto Pinochet’s 17-year military dictatorship ended, democratic rule returned to Chile. Since then, Indigenous organizations have mobilized to demand restitution of their ancestral territories seized over the past 150 years. Sentient Lands is a historically grounded ethnography of the Mapuche people’s engagement with state-run reconciliation and land-restitution efforts. Piergiorgio Di Giminiani analyzes environmental relations, property, state power, market forces, and indigeneity to illustrate how land connections are articulated, in both landscape experiences and land claims. Rather than viewing land claims as simply bureaucratic procedures imposed on local understandings and experiences of land connections, Di Giminiani reveals these processes to be disputed practices of world making. Ancestral land formation is set in motion by the entangled principles of Indigenous and legal land ontologies, two very different and sometimes conflicting processes. Indigenous land ontologies are based on a relation between two subjects—land and people—both endowed with sentient abilities. By contrast, legal land ontologies are founded on the principles of property theory, wherein land is an object of possession that can be standardized within a regime of value. Governments also use land claims to domesticate Indigenous geographies into spatial constructs consistent with political and market configurations. Exploring the unexpected effects on political activism and state reparation policies caused by this entanglement of Indigenous and legal land ontologies, Di Giminiani offers a new analytical angle on Indigenous land politics.
