This book reconstructs and classifies, according to ideal-typical models, the different positions taken by the major contemporary legal theories as to whether and how law relates to politics. It presents a possible explanation as to why different legal theories, though often reaching diametric results, somehow must still begin from common basic points.

Through an examination of Canadians' complicated roles as agents and objects of globalization, this book shows how Canada's experience of and contribution to globalized governance is characterized by serious imbalances. It explores these imbalances by tracing three interlinked developments: the emergence of a neoconservative supraconstitution, the transformation of the nation-state, and the growth of governance beyond the nation-state. Advocating a revitalized Canadian state as a vehicle for pursuing human security, ecological integrity, and social emancipation, and for creating spaces in which progressive, alternative forms of law and governance can unfold, this book offers a compelling analysis of the challenges that middle powers and their citizens face in a globalizing world.

The study of law and politics is one of the foundation stones of the discipline of political science, and it has been one of the most productive areas of cross-fertilization between the various subfields of political science and between political science and other cognate disciplines. This Handbook provides a comprehensive survey of the field of law and politics in all its diversity, ranging from such traditional subjects as theories of jurisprudence, constitutionalism, judicial politics and law-and-society to such re-emerging subjects as comparative judicial politics, international law, and democratization. The Oxford Handbook of Law and Politics gathers together leading scholars in the field to assess key literatures shaping the discipline today and to help set the direction of research in the decade ahead.

"This book hypothesises that an ILI perspective offers a better explanation of the law-State behaviour relationship during international crises than rival explanations grounded in positivism, realism or functional ism. Four case studies of State behaviour - of the US, the Soviet Union and the PRC during the Korean War (1950-1953), of the US and UK during the Suez crisis (1956), of the US and the Soviet Union during the Cuban Missile Crisis (1962) and of the US and an alliance of Latin American States during the Dominican Republic crisis (1965) - are used to test the hypothesis. The findings confirm the greater explanatory efficacy of ILI and demonstrate that the significance of international law to foreign policy decision-making during international crises is more than that of deterring the use of force as is assumed by rival theoretical approaches grounded in a rule-book image of international law."--Back cover.
