This book focuses on the Polish Constitution of 1997, concentrating on its structure, its substance and some of the institutional choices made by the drafters. The core of the Constitution is similar to other liberal democratic constitutions, but, in addition, it regulates a number of issues – such as public finances and sources of law – that are new to Polish constitutionalism and to constitutionalism in general. It considers in a detailed manner certain institutional choices made in the Constitution, such as the bicameral parliament, the peculiar structure of the executive branch, as well as the principle of independence of courts and judges, fundamental rights and local government. The book is a vital resource for all those interested in Poland's Constitution, and the rich comparative constitutional insights the country offers. In addition to explaining the 1997 Constitution in its political, historical, and social context, the book tackles the radical changes, in particular within the judicial branch, introduced by the new governing majority since 2015. These new regulations, constitutional in character, but without formally changing the Constitution, challenged the rule of law, a key component of membership in the European Union. Despite the negative nature of these recent developments, the anchoring of Polish constitutional law in European constitutionalism presents a source of optimism that the 1997 Constitution will regain its position as the supreme law of the state.

Niniejsze opracowanie jest pierwszym w języku polskim całościowym i systematycznym wykładem na temat prawa ustrojowego Niemiec. Wyłożeniem tezy, że prawo konstytucyjne jest skodyfikowaną polityką. Po drugie, żaden inny kraj europejski nie wytworzył w stosunkowo krótkim odcinku czasu tak bogatej politycznie kultury federalnej jak właśnie Niemcy po 1949. I po trzecie wreszcie, proces wykształcania tego modelu, który nie był i nadal nie jest łatwy, uświadamia, jak ważną rolę ma w nim do odegrania orzecznictwo konstytucyjne. Rola strażnika ustrojowych reguł gry, jaką spełnia w Niemczech Trybunał Konstytucyjny, uzmysławia bowiem, że funkcjonowanie demokratycznego państwa prawa jest co prawda wypadkową działania różnych sił politycznych, ale i następstwem ustanowionych w konstytucji wzorców ustrojowego postępowania.

W imieniu przyjaciół i kolegów z Wydziału Prawa i Administracji Uniwersytetu Jagiellońskiego pragnę złożyć najserdeczniejsze gratulacje Panu Profesorowi Jackowi Czajowskiemu z okazji Jego Jubileuszu. Od czasu ukończenia studiów na naszym Wydziale aż do przejścia na emeryturę całe swoje życie zawodowe związał Jacek Czajowski właśnie z tym Wydziałem. Od początków kariery naukowej, przypadających na lata sześćdziesiąte, pracował pod kierunkiem wybitnych uczonych: pracę magisterską napisał na seminarium Profesora Stanisława Grodziskiego, pracę na Uniwersytecie rozpoczął w Katedrze kierowanej przez Profesora Witolda Zakrzewskiego. Dzieląc swoje zainteresowania pomiędzy historię a współczesność, skoncentrowany na problematyce ustroju państwowego, wybrał Jacek Czajowski karierę konstytucjonalisty. Swoje prace poświęcał zarówno ustrojowi państw Ameryki Łacińskiej, jak i Drugiej oraz Trzeciej Rzeczypospolitej. Nie był to jednak jedyny nurt jego twórczości naukowej – drugi stanowiły prace o charakterze biograficznym. We wspomnieniach współpracowników, poza świadomością wybitnych osiągnięć naukowych Jacka Czajowskiego, dominuje jednak przede wszystkim Jego Osoba jako życzliwego kolegi, interesującego rozmówcy i człowieka o dużym poczuciu humoru, popularnego wśród studentów wykładowcy. Wszystko to składa się na obraz Człowieka, którego osobowość i działalność na zawsze wzbogaci najnowszą historię naszego Wydziału. Pragnę więc podziękować Mu za lata spędzone wśród nas i życzyć wielu dalszych zdrowych i pogodnych lat, wypełnionych twórczością naukową, a także wszelkiej pomyślności w życiu osobistym.
