The topic of polygamy in Islamic countries is generally perceived by outsiders as something linked to harems and Hollywood-style foreign intrigues. The practice is frequently viewed through sexual connotations and male power versus female powerlessness. This book sheds light on the often misunderstood polygamous situation in modern Saudi Arabia. Through a unique series of local interviews with both men and women involved in polygamy, both maritally and professionally, the author invites the reader into the homes and personal lives of the people directly affected. The result is a moving, candid examination of the frame of mind, impulses, incentives, reasons, and circumstances that drive individuals towards polygamy, as well as the social, legal, economic, and emotional consequences that inevitably follow. The book also examines the historical origins of Islamic polygamy in Mecca and Medina, as well as the legal situation in Saudi Arabia today. The author argues that a combination of gender differences created through local laws and public policy decisions, the revival of customary tribal practices, and the pressures created by the sudden materialism of modern life have all led towards a misapplication of the original Islamic legal essence of the practice, and a re-adaptation of the laws regulating it.

Women Islam And Everyday Life written by Nina Nurmila and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-06-10 with Political Science categories.

This book examines Islam and women’s everyday life, focusing in particular on the highly controversial issue of polygamy. It discusses the competing interpretations of the Qur’anic verses that are at the heart of Muslim controversies over polygamy, with some groups believing that Islam enshrines polygamy as a male right, others seeing it as permitted but discouraged in favour of monogamy, and other groups arguing that Islam implicitly prohibits polygamy. Based on detailed fieldwork conducted in Indonesia, it provides an empirically-based account of women’s lived experiences in polygamous marriages, describing the different perceptions of the practice and strategies in dealing with it. It also considers the impact of changing public policy, in particular Indonesia’s 1974 Marriage Law which restricted the practice of polygamy. It shows that, in fact, this law has not resulted in widespread adherence, and considers how public policy could be modified to increase its effectiveness in affecting behaviour in everyday life. Overall, the book argues that polygamy has been a source of injustice towards women and children, that this is against Islamic teaching, and that a just Islamic law would need to call for the abolition of polygamy.

In both the West and throughout the Muslim world, Islamic family law is a highly and hotly debated topic. In the Muslim World, the discussions at the heart of these debates are often primarily concerned with the extent to which classical Islamic family law should be implemented in the national legal system, and the impact this has on society. Family Law in Islam highlights these discussions by looking at public debates and legal practice. Using a range of contemporary examples, from polygamy to informal marriage (zawaj 'urfi), and from divorce with mutual agreement (khul') to judicial divorce (tatliq), this wide-ranging and penetrating volume explores the impact of Islamic law on individuals, families and society alike from Morocco to Egypt and from Syria to Iran. It thus contains material of vital importance for researchers of Islamic Law, Politics and Society in the Middle East and North Africa."

This book focuses on Islamic family law as interpreted and applied by judges in Europe, Australia and North America. It uses court transcriptions and observations to discuss how the most contentious marriage-related issues - consent and age of spouses, dower, polygamy, and divorce - are adjudicated. The solutions proposed by different legal systems are reviewed , and some broader questions are addressed: how Islamic principles are harmonized with norms based on gender equality, how parties bargain strategically in and out of court, and how Muslim diasporas align their Islamic worldview with a Western normative narrative.
