No seguimento do estudo A Criminalidade de Estrangeiros em Portugal: Um Inquérito Científico, nesta obra os autores debruçam-se sobre o denominado topo da pirâmide da criminalidade, isto é, a realidade dos estrangeiros reclusos em Portugal. Nesse sentido, foram analisadas as estatísticas oficiais da Direcção Geral dos Serviços Prisionais nos 10 anos compreendidos entre 1994 e 2003, sendo prestado especial enfoque a esta último ano. Entre 1994 e 2003 o número de estrangeiros recluídos no sistema prisional português passou de 991 para 2 145. Este crescimento de 116% é superior ao verificado para a população de reclusos em geral, resultando por isso num aumento da proporção de estrangeiros neste universo de 9,6% em 1994 para 15,7% em 2003. A evolução da população estrangeira com residência legal em Portugal foi, segundo dados oficiais, de 176% no mesmo período. É abusivo pensar nos estrangeiros residentes como equivalendo à base de recrutamento dos estrangeiros condenados a penas de prisão efectiva. No entanto, é interessante constatar que o crescimento de reclusos estrangeiros observado foi mais lento do que o da população estrangeira legalmente residente. As nacionalidades com maior historial imigratório no contexto português, nomeadamente os PALOP’s e o Brasil, são as mais representadas no sistema prisional ao longo dos 10 anos sob análise. Ainda assim, a presença dos cidadãos espanhóis entre as nacionalidades mais frequentes demonstra que a evolução acima identificada não pode ser vista como resultante exclusivamente dos movimentos imigratórios. Enquadrando a situação portuguesa no contexto da União Europeia, verificamos que, em Setembro de 2003, o peso de estrangeiros no sistema prisional português era, segundo o Conselho da Europa, o quarto mais baixo da UE15 e o décimo mais baixo da UE25. Apurando esta comparação através da introdução do peso da população estrangeira na população total de cada país neste rácio, Portugal passa a ser o quarto país da UE25 com menor sobrerepresentação de estrangeiros no sistema prisional quando comparados com o peso dos existentes na população residente. Da análise do ano de 2003 verificamos a existência de fortes discrepâncias, possivelmente denunciando tratamentos diferenciados, entre portugueses e estrangeiros no que toca aos regimes prisionais, nomeadamente na pouco frequente aplicação do regime aberto a estrangeiros, e igualmente na pouco frequente aplicação da vigilância electrónica. Por outro lado, da análise dos reclusos saídos durante 2003, verificamos, à semelhança do observado no estudo relativo ao sistema judicial, uma mais frequente aplicação da prisão preventiva de forma incorrecta a estrangeiros, resultando em inúmeras saídas por posterior aplicação de medidas de coação não detentivas, por absolvição, ou por penas não detentivas. Por fim, a reflexão sobre a questão da disparidade entre a proporção de estrangeiros em Portugal e no sistema prisional português conduziu-nos a uma pluralidade de cenários alternativos, nenhum dos quais ‘verdadeiro’ mas todos eles mais correctos do que pegar em duas percentagens sem pensar em que condições são produzidas e no que efectivamente traduzem. Concluímos pois que a simplicidade com a qual é usual comparem-se estrangeiros na prisão com estrangeiros na população é uma das proverbiais aparências que iludem.
