Preso atto della crescente espansione nel diritto positivo delle ipotesi di premialità legate alla condotta del reo successiva al reato, il volume affronta il tema del ravvedimento postdelittuoso al fine di vagliare le condizioni costituzionali di impiego di un siffatto paradigma. L’indagine, dopo alcuni cenni di carattere storico e giusfilosofico, si sforza anzitutto di operare una ricostruzione della natura giuridica e delle rationes politico-criminali che stanno a sostegno della premialità postdelittuosa. Si è così osservato il profondo legame sussistente tra tali previsioni e i fondamenti giustificativi della pena, nelle cui complesse e articolate vicende il fenomeno qui esaminato si inserisce. Il lavoro si concentra poi sull’analisi del diritto positivo, orientata a cogliere la natura e il fondamento delle singole fattispecie vigenti, nonché eventuali reciproche connessioni. Considerato l’approfondimento che il tema del premio per la condotta postdelittuosa ha storicamente ricevuto in Germania, particolare attenzione è riservata al diritto e alla letteratura tedesca, che trovano richiamo nel corso della trattazione, oltreché approfondimento in un capitolo dedicato. Nell’ultima parte si propone una nuova classificazione delle ipotesi di ravvedimento e si giunge alla definizione delle forme e dei limiti che dovrebbero contrassegnare la premialità postdelittuosa in modo da renderla conforme ai principi costituzionali che regolano la materia penale, osservandosi come, entro le direttrici indicate, tali fattispecie possono contribuire positivamente al realizzarsi degli scopi della pena, offrendo un apporto decisivo alla complessiva razionalizzazione del sistema.

It is clear that the Lutheran Reformation greatly contributed to changes in theological and legal ideas - but what was the extent of its impact on the field of contract law? Legal historians have extensively studied the contract doctrines developed by Roman Catholic theologians and canonists; however, they have largely neglected Martin Luther, Philip Melanchthon, Johann Aepinus, Martin Chemnitz, Friedrich Balduin and many other reformers. This book focuses on those neglected voices of the Reformation, exploring their role in the history of contract law. These men mapped out general principles to counter commercial fraud and dictated norms to regulate standard economic transactions. The most learned jurists, such as Matthias Coler, Peter Heige, Benedict Carpzov, and Samuel Stryk, among others, studied these theological teachings and implemented them in legal tenets. The power of the prince versus the rights of his subjects is one of the basic struggles in the history of law and government.
