El paso de la Europa de las fronteras a la de la libertad de movimientos, así como la absoluta modernización de los mercados y de los medios de transporte, ha traído consigo una mayor facilidad para delinquir. Tras la entrada en vigor del Tratado de Lisboa, el tema suscita un interés creciente, toda vez que los problemas que genera la delincuencia organizada van en aumento, en una sociedad que funciona con mayor dinamismo día a día, y en la que los sujetos internacionales interactúan cada vez más entre sí en busca de soluciones. En esta monografía se aborda y estudia crítica y sistemáticamente la normativa y las herramientas funcionales que la UE ha desarrollado en esta materia hasta la actualidad, el marco jurídico y operativo que ha edificado para la lucha contra la delincuencia organizada dentro del desarrollo del Espacio de Libertad, Seguridad y Justicia, sus logros y sus problemas. La armonización legislativa de los Estados miembros, el aumento competencial de Europol, Eurojust, CEPOL y otras agencias relacionadas, así como la creación del Fiscal Público Europeo y personal específico de la UE para esta lucha son algunas de las propuestas que hace el autor, así como el aumento de medios para todos ellos y la concienciación de los ciudadanos sobre la dimensión del problema. El autor, Doctor en Derecho Internacional Público y Relaciones Internacionales, ha desarrollado sus estudios en Derecho de la Unión Europea, especializándose en materia de seguridad pública, ampliando su interés a la delincuencia grave y organizada y a la justicia penal internacional, con un especial estudio de la cooperación policial y en asuntos de interior entre los Estados. Ha trabajado como profesor de Derecho Internacional Público, Derecho Constitucional e Historia del Derecho en el ámbito universitario.

The primary thrust of the monograph is to explain the linkage of contemporary criminal street gangs (that is, the gang phenomenon or third generation gangs) to insurgency in terms f the instability it wreaks upon government and the concomitant challenge to state sovereignty. Although there are differences between gangs and insurgents regarding motives and modes of operations, this linkage infers that gang phenomena are mutated forms of urban insurgency. In these terms, these "new" nonstate actors must eventually seize political power in order to guarantee the freedom of action and the commercial environment they want. The common denominator that clearly links the gang phenomenon to insurgency is that the third generation gangs' and insurgents' ultimate objective is to depose or control the governments of targeted countries. As a consequence, the "Duck Analogy" applies. Third generation gangs look like ducks, walk like ducks, and act like ducks - a peculiar breed, but ducks nevertheless! This monograph concludes with recommendations for the United States and other countries to focus security and assistance responses at the strategic level. The intent is to help leaders achieve strategic clarity and operate more effectively in the complex politically dominated, contemporary global security arena.
