El fenómeno delictivo de la corrupción ha alcanzado en los últimos años una expansión creciente que requiere ser analizada desde una óptica multidisciplinar sin concentrarse únicamente en el estudio de las diversas infracciones presentes en el Código penal, punto de partida tradicional en el que se ha centrado hasta la fecha la doctrina jurídico-penal. Desde esta óptica, el libro aborda, en primer lugar, el estudio de los procedimientos de contratación de las administraciones públicas y los problemas a los que se enfrentan los organismos públicos. En segundo lugar, habida cuenta de las imbricaciones transnacionales del fenómeno, es necesario redefinir el concepto de corrupción, ajustándolo a esta nueva dimensión en la que además se va disolviendo la frontera entre lo público y lo privado. Ello implica, entre otras cuestiones, un análisis pormenorizado de las nuevas formas delictivas de corrupción entre particulares y de corrupción de funcionario público en transacciones comerciales internacionales, recientemente incorporadas a nuestro Código penal y de escasa, por no decir nula, tradición jurídica en nuestro país. En tercer lugar, se aborda la relación entre la financiación ilegal de partidos políticos y la corrupción, destacándose, pese a las reformas de 2015, la ausencia de leyes adecuadas sobre la financiación de los partidos, de mecanismos eficaces de control de sus cuentas y de sanciones contra los infractores. Finalmente, se aborda la necesidad de mejorar los instrumentos procesales de investigación así como el auxilio judicial de ciertos organismos. Sólo desde la evaluación de todos los instrumentos existentes podrá comprobarse su pertinencia y utilidad y proponer cambios efectivos que redunden en la mejora de la prevención del fenómeno de la corrupción y, en su caso, en su castigo.

Scholars and human rights monitoring bodies have started to make the connection between corruption and human rights violations. When asked about this connection, most people easily picture a country ruled by a dictator who steals public money to support his luxury lifestyle, while the population suffers from the lack of essential public services, such as healthcare and education.
