La "libertad negativa" del liberalismo es una "libertad" gnóstica de origen protestante, una "libertad" concebida como "liberación", esto es, una "libertad" ejercitada con el solo criterio de la libertad, o sea, sin ningún criterio. Últimamente se viene difundiendo en el discurso contemporáneo a través de la llamada "autodeterminación", que al principio pareció referirse sobre todo al ámbito colectivo (el llamado derecho a la autodeterminación de los pueblos), pero que ha acogido luego también el ámbito individual (el llamado derecho al libre desarrollo de la personalidad). Cuestiones, ambas, de la mayor trascendencia para el derecho público y la filosofía de la política. Razón por la que fueron escogidas como tema central del X Congreso Internacional de la Asociación Colombiana de Juristas Católicos, patrocinado por la Universidad Católica de Colombia (Santafé de Bogotá), según un proyecto de investigación de la Unión Internacional de Juristas Católicos (Roma), el Grupo Sectorial de Ciencias Políticas de la Federación Internacional de Universidades Católicas (París) y el Consejo de Estudios Hispánicos Felipe II (Madrid). Esta obra es complemento y continuación del libro del mismo autor Historias de procesalistas, universidades y una guerra civil (1900-1950) (Universidad Carlos III de Madrid/ed. Dykinson, Madrid, 2012), e incluye diversos trabajos elaborados en los últimos años y referidos a procesalistas del pasado más o menos reciente. A estos efectos, el concepto de procesalista se entiende en sentido amplio, que comprende no sólo a los juristas que se dedicaron profesionalmente a esta materia, sino también a otros juristas que, con reiteración o de forma ocasional, publicaron estudios de contenido procesal. En la Nota de edición que figura en la parte final del libro, se indican las publicaciones en las que vieron la luz los estudios reunidos en esta obra, manteniéndose íntegramente la versión con la que fueron publicados. Los trabajos compilados se atienen al orden cronológico de los hechos que se estudian en cada uno de ellos.
