English summary: The modern term constitution is closely associated with the revolutions of 1776 and 1789. The discussion surrounding the preconditions of the constitution not only reflects how the revolution was able to overcome the old, class conscious society, but rather the general process of legal regulation of governance in the spirit of the Enlightenment. The concentration of monarchies in the world of European constitutions after 1800 was a mirror of Napoleonic state authoritarianism. In her study, Ulrike Mussig demonstrates that the growing strength of the parliaments after the July Revolution in 1830/31 led to a smooth transition from a constitutional to a parliamentary system with consistent laws. The balance of power between the monarch and parliament was changing. This evolutionary understanding of constitutional history is the key to Ulrike Mussig's study on the European constitutional discussion in the 18th century. Dadurch kam es in Frankreich, Belgien und England zu einem erheblichen Parlamentarisierungsschub, wahrend in der deutschen Verfassungspraxis der repressive bundespolitische Rahmen einen dauerhaften Einfluss der Kammern auf die monarchisch bestimmten Regierungen verhindert hat.Gerade diese Offenheit des Konstitutionalismus im Verhaltnis zwischen Monarch und Parlament zeigt, dass es Verfassungsgeschichte nicht mit statischen Ordnungszusammenhangen der Herrschaftsbegrundung und -begrenzung zu tun hat. Das Krafteverhaltnis der Verfassungsgrossen ist vielmehr in Bewegung. Dieses evolutionare Verstandnis der Verfassungsgeschichte beherrscht die Studie zur europaischen Verfassungsdiskussion.

The Weimar Republic – from 1919 until 1933, when Hitler came into power – witnessed crucial debates on law and politics. These debates are reexamined in this book. Were, for example, democratic rules and procedures an adequate basis for democracy, as Hugo Preuss and Hans Kelsen suggested? Or should constitutional law elaborate the deeper, basic principles embedded in the democratic constitution itself, as Hermann Heller argued? Was the president the immediate “guardian of the constitution”, as Carl Schmitt’s concept of “representation” suggested? Or was Schmitt’s concept itself subject to Walter Benjamin’s critique of the aura of authenticity? These, and other typical Weimar-era debates helped shape West German constitutionalism. The former labor lawyer on the left Ernst Fraenkel, for example, began to develop a general theory of dictatorship mass democracy while in exile, which influenced the new discipline of political science after the war. Similarly, Gerhard Leibholz, an anti-positivist lawyer in Weimar, served on the first Constitutional Court of the Federal Republic of Germany, helping to consolidate its new constitutional culture.
