Fidèle à la tradition des précis Dalloz, la 36e édition du précis de procédure civile prend en compte l'ensemble des évolutions récentes qu'a connues le droit du procès civil, tout en livrant une vision panoramique du procès civil alliant exposition des grands principes directeurs et déclinaisons techniques de ces principes. Cette 36e édition est notamment à jour de la loi n° 2021-1729 du 22 décembre 2021 pour la confiance dans l'institution judiciaire et de ses décrets d'application, celui du 11 octobre 2021 (n° 2021-1322) et celui du 25 février 2022 (n° 2022-245) favorisant le recours à la médiation. Soucieuse de maintenir une présentation pédagogique du procès civil, cette nouvelle édition s'enrichit d'un chapitre nouveau consacré aux procédures accélérées définitives (à la suite de la systématisation des procédures dites " accélérées au fond " dans le code de procédure civile et des modifications récemment apportées à la procédure en injonction de payer). Ce chapitre vient compléter celui qui existait déjà pour les procédures provisoires en référé et sur requête. Le chapitre relatif aux MARD (modes amiables de règlement des différends) est enrichi par les nouvelles dispositions portant sur des incitations de recours aux MARD, ou encore sur les facilitations d'exécution de l'accord amiable. Il fait également état des propositions issues du rapport sur " La médiation devant la Cour de cassation " remis en juillet 2021. De manière générale, l'ouvrage rend compte, au plus près, des grands mouvements qui continuent d'affecter la physionomie du procès civil contemporain : managérialisation de la justice, dématérialisation de la procédure, développement de l'open data des décisions de justice, fondamentalisation renforcée du droit du procès civil, sous l'influence conjointe des droits constitutionnel (via la QPC) et européen (avec les mises en œuvre récentes des protocoles additionnels n° 15 et n° 16 à la Convention EDH), entreprises d'harmonisation du procès civil européen (avec les Règles modèles européennes de procédure civile ELI/Unidroit), réflexions de la Commission " Cour de cassation 2030 ", etc. Elle intègre également les réflexions sur les moyens financiers et humains de la justice civile ainsi que sur les perspectives de réformes futures – à long et moyen terme –, actuellement mis au cœur des travaux et réactions autour des Etats généraux de la justice.
