Instead of the usual apologetic treatment found in legal doctrine, linked to the determinacy, immutability or predictability of norms, this book treats legal certainty innovatively, holistically and in depth. Using a method at once analytical and functional, Professor Ávila examines the structural elements of legal certainty, from its definition and foundations to its various dimensions, normative forces and efficacies, citing a wealth of examples from case law to support each of the theses defended. No subject is more important and topical than legal certainty. Problems relating to lack of understanding, instability and unpredictability of law intensify day by day everywhere, in civil law and common law countries alike. Normative sources are increasingly diverse in origin (national, international, community) and multiple in nature (legal, contractual, jurisprudential). They change constantly, and present increasingly frequent problems of ambiguity and vagueness that significantly hinder their comprehension. Sobre a obra Tributação e Desigualdade Pós-Pandemia – 1a Ed – 2023 "Periodicamente o ICET promove a pesquisa sobre temas relevantes de Direito Tributário, na intenção de colaborar com o aprimoramento da ordem jurídica. Desta feita, o Instituto escolheu estudar tributação e desigualdade, assunto longamente maturado em reuniões de trabalho nas quais o professor Hugo de Brito Machado reitera sua preocupação com a desigualdade social que existe em nosso País. Há muito Hugo Machado preconiza medidas tendentes a reduzir a regressividade do sistema tributário, como a instituição do Imposto sobre Grandes Fortunas – IGF, a efetiva progressividade dos impostos patrimoniais, a reformulação da tabela de incidência do imposto de renda das pessoas físicas para que deixe de alcançar o mínimo existencial e, em paralelo, a redução dos impostos sobre o consumo. Sustenta a implementação de incentivos fiscais fomentadores de atividade econômica nas regiões mais pobres do país, lembrando que a tão combatida guerra fiscal cumpre o que está na Constituição e tem sido o único instrumento tributário eficaz no ataque às desigualdades regionais. Hugo Machado ressalta que o combate à desigualdade não se resume ao equilíbrio da arrecadação de tributos, sendo imprescindível que o gasto público seja movido pela solidariedade social e realizado com seriedade tendo em vista, sobretudo, a necessidade dos mais pobres. Nosso propósito é despertar o espírito crítico e o interesse no aperfeiçoamento do sistema tributário, no sentido de atenuar a desigualdade abismal que separa alguns brasileiros de muitos outros brasileiros. O assunto ganha especial relevo quando o Presidente da República, no discurso de posse do seu terceiro mandato, reconhece a necessidade inadiável de reduzir a histórica desigualdade social brasileira e mostra interesse em combatê-la inclusive com instrumentos fiscais. O presente volume não traz apenas análises do direito posto, contém vários textos abordando o assunto a partir de valores que podem nortear a feitura e aplicação de novas leis tributárias que tenham como objetivo diminuir ou ao menos evitar que essa desigualdade se acentue. O momento é propício para isso. Mantivemos a sistemática de ofertar perguntas aos convidados, com o único intuito de orientar o desenvolvimento dos trabalhos. This original and stimulating book is the first systematic study of the principle of `legitimate expectations' in administrative law to appear in the English language. The notion of reasonable or legitimate expectations has played a central role in the development of administrative law over the last thirty years and it remains one of the most contentious and most frequently invoked grounds of judicial review. In this book Dr Schonberg provides a detailed, comparative, and critical analysis of that notion He begins by clarifying why administrative law should protect expectations at all, by linking expectations to fairness, trust in administration, and the Rule of Law with its requirements of legal certainty and formal equality. In the light of this framework he examines in detail the principles and rules which contribute to the protection of expectations. The scope of this analysis is broad, looking both at procedural and substantive principles of administrative law as wellas principles of tort liability and stautory compensation. In all of these areas, English law is carefully compared with French and EC law and is shown how the three legal systems often reach similar outcomes by the application of different legal principles and rules. The current state of English law is examined critically in the light of the comparative study of French and EC law, and a number of original suggestions for legal reform are presented. They include the adoption of: a generalprinciple of irrevocability of intra vires administrative decisions, a distinct principle of substantive legitimate expectations subject to a `significant imbalance' threshold for judicial intervention, and a statutory right to compensation for loss caused by `sufficiently serious' violations of public law.
