“Roma Tre Law Review” is a law review sponsored by the Department of Law of the University of Roma Tre. This book argues that European citizenship is transnational, a status that has emerged incrementally during the European integration process. Transnational Citizenship in the European Union follows an institutionalist approach and traces the development of citizenship discourse from the founding treaties of the EU to the most recent effort of constitution-making and the Lisbon Treaty. This helps demonstrate that such discourse has followed a path based on the foundational principles of free movement and non-discrimination rather than revolutionary ideas of a postnational citizenship beyond the nation-state. This in-depth analysis of citizenship in the EU takes into account the institutional configuration of membership, rights, identity, and participation. It also brings in the domestic level of the debate through the examination of national positions on reform proposals and the interplay between EU and member states conceptions of citizenship. Lastly, by investigating citizenship practices, the book helps foster understanding of how the EU works as a political system, and the relationship between European institutions and the recipients of their integrative politics , i.e., the citizens.

Whereas much has been written on the subject of art, the literature on the figure of the artist has been relatively scant. There are certainly countless biographies as well as essays dedicated to particular aspects of art - for example, the relationship between artists and their patrons - but there is no comprehensive text that puts together the pieces of the puzzle showing how the figure of the artist changed over the millennia. An Artist’s Story of Artists is an attempt to make good this lacuna by retracing the long and often fragmented path of the artist, from the Palaeolithic until this morning, more or less. During this journey, artists assumed and shed many guises. They were magicians, priests, legends, slaves, salaried workers, entrepreneurs, inventors, lunatics, revolutionaries, scientists, patrons and much else besides. They experimented with techniques and ideas, always aiming to find new ways to make art, and overcoming the boundaries determined by society, as well as those established by themselves. Highlights of this story are the complex relationships artists have always had with writing and literature, philosophy, technology, politics, religion and criticism, and the weighty stigma on manual work that for 5,000 years subdued them as they were regarded as halfwits who were good with their hands. This substantial work is divided into five phases, five great periods that witnessed the radical ways in which artists changed as they fought and lost battles among themselves and with society, and the ups and downs they experienced from being revered shamans reduced to reviled labourers, later raised to geniuses and then turned into doomed and damned artists. This book provides a fascinating analysis of a single jurisdiction, Brazil, and accounts for both the successes and the failures of its most recent constitutional project, inaugurated by the Constitution of 1988. It sets out the following aspects of the constitutional development and erosion: - the different phases of the promised transition from military rule to a 'social-democratic constitutionalism'; - the obstacles to democratisation derived from the absence of true institutional reforms in the judicial branch and in the civil-military relationship; - the legal and social practices which maintained a structure that obstructed the emergence of an effective social-democracy, such as the neoliberal pattern, the acceptance in the political field of unlawful organisations, such as the milícias, and the way the digital revolution has been harming the formation of democratic sovereignty. Situating Brazil in the global context of the revival of authoritarianism, it details the factors which are common to the third wave of democratisation reflux. Accounting for those aspects, particular to the Brazilian jurisdiction, it shows that there is a tension in the Brazilian constitution. On the one hand, such constitutionalism was renewed by democratic pressure on governments to undertake social politics since 1988. On the other hand, it retained authoritarian practices through the hands of diverse institutions and political actors. By exploring the ideas of constitutional erosion and collapse, as well as democratic, social and digital constitutionalism, the book presents a comparative analysis of Brazil and other jurisdictions, including the United States, South Africa, and Peru.

This book examines the life of Maria Duran, who was born with female genitalia, but was accused of being a man and subsequently put on trial for sorcery by the Portuguese Inquisition during the 18th century. François Soyer uses Maria's story to open a window onto the world of the experience of 'transing' gender, as well as the gendered attitudes and responses to the transgression of gendered norms that were adopted by churchmen, medical practitioners and ordinary lay men and women. Drawing on the surviving (and staggeringly 736-page long) sorcery trial dossier, Soyer analyses the secretive life of an individual who actively and deliberately 'transed' gender. The dossier analysis enables insights into aspects of life so rarely recorded in early modern documents: the transgression of gender norms, transgressive sexuality and sexual violence in female religious institutions, in addition to the fears and debates about the power that the Devil could wield over the human body. The 'Catalan Hermaphrodite' and the Inquisition also reveals how the Inquisition gathered a number of doctors, surgeons and midwives to conduct careful examinations of Maria's body in general and genitals in particular. Their reports and the discussions of the inquisitors are discussed by Soyer and offer further fascinating evidence of attitudes towards sex and gender in early modern Europe.
