O assunto, como já mencionado, é polêmico. E, dentre os assuntos polêmicos tratados nesse livro, podemos citar, sem exaustão: (i) a possibilidade de condenação em ônus de sucumbência; (ii) a natureza da sentença que julga a ação probatória; (iii) a limitação do direito de defesa no respectivo procedimento; (iv) as possibilidades recursais no processo probatório; (v) a própria natureza da ação probatória; (vi) sua ligação com o processo cautelar; (vii) a possibilidade da ação probatória como preparação da ação monitória; (viii) o tema nas searas trabalhista, previdenciária e do juizado especial; (ix) a possibilidade de tutela de urgência nesta demanda; (x) a autorização legal para formulação da pretensão probatória de maneira incidental; (xi) o princípio da cooperação no processo probatório; (xii) o estudo da produção antecipada da prova no procedimento arbitral; (xiii) a relação da ação probatória com a exibição de documentos; (xiv) o direito fundamental à prova. O projeto desta obra foi idealizada no início de 2017. Chega à conclusão após mais de um ano e meio. Não houve pressa!
