Am 14. November 2007 ist das Umweltschadensgesetz in Kraft getreten, welches der Umsetzung der im Jahre 2004 erlassenen Umwelthaftungsrichtlinie der Europaischen Gemeinschaft dient. Der Vollzug des Umweltschadensgesetzes wird zwangslaufig Fragen aufwerfen; unter anderem, ob und in welcher Weise das Umweltschadensgesetz im Chemikalienbereich relevant werden kann. Dies beleuchtet die vorliegende Untersuchung, wobei in erster Linie die produktbezogene Umweltschadenshaftung fur chemische Stoffe und Pflanzenschutzmittel in den Blick genommen wird. Angesprochen ist damit die Fragestellung, ob und ggf. unter welchen Voraussetzungen der Hersteller, Vertreiber und Anwender einer Chemikalie oder eines Pflanzenschutzmittels fur Umweltschadensfalle haftet, die aus der Verwendung des Stoffes resultieren.
