Until 1969, the City of Winnipeg had undertaken only two public housing projects even though the failure of the market to provide adequate housing for low-income Winnipeggers had been apparent since the beginning of the century. By 1919, providing housing was a significant issue in municipal politics that was embraced by civic officials, professionals, reformers, labour leaders and social democratic politicians. It also became a proxy issue for refighting the 1919 General Strike at city hall. However, Winnipeg’s business community proved effective opponents of public housing. The struggle for public housing was also a struggle for democracy. Up until the 1960s, public housing required approval by a referendum in which only the city’s property owners could vote. This rule deprived close to half the city’s voters — and virtually everyone who might qualify to live in public housing — of the right to vote. Over decades that barrier to democracy was whittled away. An NDP provincial government elected in 1969 added 11,144 units of public housing to the existing 568 units. Today public housing is once more under attack. Rather being treated as valued public assets, they are considered embarrassing encumberments that should be sold as part of a process of turning public housing over to the private sector. The struggle to protect and expand the provision of non-profit housing is undermined by the rupture in political memory of the long struggle to build public housing and the current political situation.

Through a series of simple survey experiments, Property Rights and Property Wrongs explores how political power, personal connections, elections, concerns for reputation, legal facts, and social norms influence property rights disputes from hostile corporate takeovers to debt collection to renationalization. This work argues that property rights in Russia are better seen as an evolving bargain between rulers and rightholders than as simply a reflection of economic transition, Russian culture, or a weak state. The result is a nuanced view of the political economy of Russia that contributes to central debates in economic development, comparative politics, and legal studies.

Like most wild living resources, fish present a complex management challenge. Given the failure of command and control regulatory regimes to protect fisheries, scholars and practitioners have advocated the use of property rights to rectify the fisheries crisis. This meta analysis argues that property rights can be used constructively as a regulatory measure in the sustainable management of fisheries, and perhaps in other areas of resource management. However, the use of property rights to resolve resource problems is context dependent, and no single regulatory option or policy is appropriate for the multi-faceted and highly variable world of fisheries management. This paper characterizes and contrasts three regulatory regimes in fisheries management in the United States, while drawing from lessons learned worldwide about fisheries regulation. The paper defines the conditions where property rights might be used appropriately-property 'rights' - as well as where property rights might be used inappropriately - property 'wrongs.'

Intellectual property has become a pervasive presence in society. Seeping into every nook and cranny of American life, intellectual property casts a protective haze over everything from the words of an email, to the shape of a phone, to the sequence of our genes. Increasingly, these rights are being used for schemes that have little to do with advancement of societal goals and much to do with societal waste. What should we do when rights that we have created with such lofty goals and noble heart are diverted toward less admirable pursuits, that is, when IP rights become the vehicles for IP wrongs? Currently, intellectual property rights are being used for purposes such as hiding embarrassing or illegal conduct, avoiding obligations, pressuring others into surrendering rights, harassing competitors, and engaging in complex anticompetitive schemes. This occurs because attributes of the system allow intellectual property rights holders to bargain for compensation beyond the value of the right -- a process that is damaging innovation, creating dysfunction in markets, and wasting vast amounts of legal resources. This article describes the phenomenon of magnification and chronicles troubling behaviors in copyright, patent and trade secret. Many of these examples have not been described in academic literature and some have not been described anywhere. The article suggests that as the marketplace for ideas develops in uncomfortable ways, we should introduce a doctrine of inappropriate use of intellectual property. The article also suggests that the FTC invoke its rarely used power for economic investigations under Section 6(b).
