En esta obra, analizamos el principio de proporcionalidad en el contexto educativo del Derecho penal de menores. De dicho análisis, concluimos que dicho principio es interpretado y aplicado de una manera sui generis en el mencionado contexto educativo; esa manera diferente de aplicar la proporcionalidad en menores precisa de una explicación -que aportamos a través de esta obra-, en el sentido que se hace necesario el exponer una justificación o fundamentación respecto al por qué la proporcionalidad es diferente en el ámbito de la jurisdicción de menores en comparación con la jurisdicción de adultos. Dicha fundamentación se halla en el principio educativo o interés superior del menor; así, y en virtud de dicho principio, podremos responder a las cuestiones siguientes de una manera coherente con el Derecho penal, y, prioritariamente, con el Derecho penal de menores: ¿proporcionalidad o educación?, ¿retribución o educación?, ¿pena o educación?, ¿castigar o educar? Respondemos a estas cuestiones huyendo de un falso dilema, porque, estas preguntas pueden surgir de un planteamiento ficticio o erróneo: dichas cuestiones pueden ser un falso dilema producto de inercias provenientes de nuestra tradición tutelar en el ámbito de menores; de dicha tradición, y, por tanto, equivocadamente, situamos la proporcionalidad y la reeducación como elementos antagónicos, sin aportar soluciones a este problema. Por ello, proponemos modificaciones de la legislación penal de menores, para abordar dicho problema, modificaciones que se sitúan en la dirección siguiente: el principio educativo es un fin, y, según aquí proponemos, la proporcionalidad es un medio al servicio de dicho fin, en la jurisdicción de menores. Analizamos, también, el principio de seguridad jurídica, por tener una relación directa con el mencionado principio de proporcionalidad, y, a partir de este contexto, porque, hemos observado que es mejorable la aplicación de la seguridad jurídica en la legislación penal de menores, mejora que repercutiría en el menor infractor favorablemente, al menos con esta intención sugerimos las propuestas de mejora.
