L'une des évolutions les plus importantes du droit du crédit, au cours des dernières années, a été le développement de l'utilisation du droit de propriété pour garantir le paiement d'une créance. La fiducie, la clause de réserve de propriété, le crédit-bail et la cession DAILLY en sont les manifestations les plus connues mais la catégorie des "propriétés - garanties " comprend, également, le report en bourse, les opérations de pension, les opérations de portage et les " gages " d'une somme d'argent. L'importance de ce phénomène a conduit l'auteur à s'interroger sur l'aptitude du droit de propriété à être un droit accessoire ou à être qualifié de sûreté. L'étude du droit de propriété, du numerus clausus des droits réels et du numerus clausus des garanties réelles montre que le droit de propriété peut exercer une telle fonction de garantie sans être démembré et, même, qu'un démembrement du droit de propriété est une " priorité de la valeur " et une " propriété de l'utilité " serait impossible. La fonction de garantie est donc sans influence sur le droit de propriété. En revanche, le droit de propriété bouleverse la théorie des sûretés puisqu'il impose l'abandon de la classification bipartite des sûretés au profit d'une classification quadripartite. L'auteur le démontre après avoir élaboré une définition de la notion de sûreté et montré que, dans le cas des propriétés - garanties fiduciaires, le droit de propriété peut, effectivement, être qualifié de sûreté. A l'opposé, les conséquences pratiques de l'utilisation du droit de propriété comme garantie sont plus limitées ainsi que le montre l'auteur en prenant la mesure des avantages et des inconvénients de la propriété - garantie pour le créancier qui en bénéficie, pour les autres créanciers et pour le débiteur. L'ouvrage a été mis à jour de la jurisprudence parue jusqu'en décembre 1994 ainsi que de la réforme du droit des entreprises en difficulté par la loi du 10 juin 1994 et le décret du 21 octobre 1994.

Comparativement à l'affection des auteurs pour une obligation voisine - la garantie des vices cachés - la garantie d'éviction dans la vente semble un thème plutôt désuet à l'aube de la naissance de l’Europe ; pourtant, l'ouverture tout proche de nos frontières donne à ce sujet un relief particulier. Cette obligation, incorporée au contrat à l'époque romaine, ne s'avère plus aujourd'hui réellement justifiée en tant que telle en raison de facteurs multiples tenant à l'économie même de notre droit interne de la vente et à la profonde nécessité d'assumer au consommateur une protection efficace et juste. En effet, triturée pour s'adapter à des situations qui outrepassent les limites traditionnelles de sa compétence, la garantie d'éviction connait actuellement une crise d'individualité et ses récentes applications, dans le domaine des ventes commerciales notamment, ne risquent pas d'infirmer ce constat. En tout cas de sa corrélation avec le droit commun des contrats et ses différents recours, on arrive à déduire la possible réparation du préjudice subi par un acquéreur dépossédé de son bien, autrement que par un régime d'exception dérogatoire aux règles régissant l'inaccomplissement des obligations qui incombent au vendeur. Alors, rassemblées sous la houlette d'un droit international fort de la concrétisation de ses propres aspirations à l'unification par la convention de Vienne du 11 avril 1980, applicable en France depuis le 1er janvier 1988, la garantie d'éviction et les sanctions de l'inexécution, enfin fusionnées, pourront engendrer une action en non-conformité juridique du produit vendu, apte désormais à prendre avantageusement la relève si le législateur français le permet.

In der italienischen Kunstproduktion und Kunsttheorie der Renaissance bezieht sich der Terminus chiaroscuro in erster Linie auf die Artikulation plastischer Werte, auf das Formulieren eines rilievo. Rilievo meint hier ein innovatives Gestaltungsprinzip, das den Eigenwert der mittelalterlichen Buntfarbe durch den Darstellungswert unbunter Farbtöne ersetzt. Malerei und Graphik tendierten im nordalpinen Raum hingegen dazu, mittels des Helldunkel die Oberflächenbeschaffenheit von Materialien zu evozieren. Aus dieser komparativen Perspektive erfasst der Band das Helldunkel als ästhetisches Prinzip, das als zentrale Signatur der gesamteuropäischen Kunstgeschichte zwischen 1300 und 1600 zu verstehen ist.
