This book proposes, for the first time, an in-depth analysis of the Philosophie sociale, published in Paris in 1793 by Moses Dobruska (1753-1794). Dobruska was a businessman, scholar, and social philosopher, born into a Jewish family in Moravia, who converted to Catholicism, gained wide recognition at the Habsburg court in Vienna, and then emigrated to France to join the French Revolution. Dobruska, who took on the name Junius Frey during his Parisian sojourn, barely survived his book. Accused of conspiring on behalf of foreign powers, he was guillotined on April 5, 1794, at the height of The Terror, on the same day as Georges Jacques Danton. From Dobruska's ideas, which were widely used between the late eighteenth century and the first decades of the nineteenth century without attribution to their author, emerge some of the key concepts of the social sciences as we know them today. An enthusiastic and unfortunate revolutionary and sometimes a brilliant theorist, Moses Dobruska deserves a role of his own in the history of sociology. This is the first of a series of national reports on basic issues concerning the acquisition and loss of ownership of movable assets. The series is planned to cover 27 European legal systems, distributed over six volumes, as a product of the research activities of the working group "Transfer of Movables" within the "Study Group on a European Civil Code". Starting with general property law issues like the concepts of ownership and possession employed in the respective legal systems, and the related means of protection, the reports primarily deal with the "derivative" transfer of ownership, but extend to good faith acquisition from a non-owner, acquisitive prescription, processing and commingling, and further related issues. The reports provide the reader with detailed information about the respective rules, case law and legal literature, prepared by national property law experts. These reports are a starting point for further comparative research in property law and also a tool for practitioners searching for information on foreign legal systems. Where available and as far as reasonable, the reports include translations of the most important statutory provisions either in the text or in an annex. Less than Nations: Central-Eastern European Minorities after WWI represents the result of research that the author has carried over recent years, and was facilitated by the 2008 PRIN project (Programmi di Ricerca di Rilevante Interesse Nazionale) and the 2010 Sapienza Research funds. The book analyses the conditions of national minorities after World War I, when the geo-political map of Central-Eastern Europe was redefined by international diplomacy. The new settlements were based on the principle of national self-determination and were conditioned by the geographic reality of Central-Eastern Europe, where states and nations rarely coincided. As a consequence, the minority question emerged as one of the most troublesome issues during the interwar period, and affected international relations and the internal conditions of many states. The minority question was discussed by historiography and by international observers, and became an integral part of the system which was centred around the League of Nations. This work begins with the study of the relationships between the states and their minorities, and of the international dimension of this question, which animated the fight between revisionist and anti-revisionist states. The documents of the Italian Army’s General Staff and of the League of Nations represent the main historical sources of this book, which carries out a complete study of the difficult situation of 1918–1920, when the new states annexed many “contested regions” within their frontiers, and of the numerous controversies concerning the application of international treaties and national regulations in relation to the protection of minorities.
