Esta momografía reflexiona sobre la necesaria modernización del Derecho del Trabajo a partir de la constatación de un modelo de regulación obsoleto e ineficiente: el de la flexibilidad laboral introducida unilateralmente por el empresario, que tiene su origen fundamentalmente en las reformas operadas durante la década de los años 90. Para ello, se ha escogido uno de los principales institutos jurídicos del trabajo por cuenta ajena -el tiempo de trabajo- ya que éste presenta la virtud de hacer emerger con nitidez el conflicto estructural entre capital y trabajo reconducido a través de la regulación jurídica.Este estudio del tiempo de trabajo se proyecta desde la necesaria confrontación de la regulación jurídica con los diversos procesos de producción que hoy envuelven al trabajo, insistiendo en la necesidad de huir de determinismos que suelen acompañar al debate sobre la transformación del proceso de producción.Para el empresariado, la obtención de un beneficio a través de la capacidad de ordenar flexiblemente los tiempos de la producción con el objetivo de adaptación de dichos tiempos a las demandas volubles de los mercados de bienes y servicios. Para los trabajadores, derechos fundamentales como la vida e integridad física y la emancipación del trabajador a través del libre desarrollo de su personalidad aparecen ligados tradicionalmente al tiempo de trabajo. El análisis jurídico de la satisfacción de los intereses de los trabajadores aparece cohesionado en este estudio a través de una visión omnicomprensiva de las desigualdades que padecen los trabajadores.El estudio finaliza con una reflexión sobre el impacto de la actual regulación jurídica del tiempo de trabajo en el interior de las clases trabajadoras, mediante la conformación de distintas identidades como consecuencia de la diversidad de estatutos jurídicos que se han ido generando en torno a la duración del vínculo jurídico de adscripción del trabajador a la empresa.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.
