"A proteção ao meio ambiente encontra as suas raízes pelo menos na Antiguidade Clássica ocidental. Em 80 d.C. o Senado de Roma aprovou uma lei para proteger o suprimento de água limpa para beber e banhar da cidade; no século XIV, a Inglaterra proibiu a queima de carvão em Londres, bem como a eliminação de resíduos nos cursos d'água navegáveis; em 1681, foi determinado, na colônia da Pensilvânia, que para cada cinco acres de terra desmatados para assentamento, um fosse preservado; no século seguinte, Franklin liderou campanhas para a redução do despejo de resíduos no meio ambiente; e, no século XIX, o governo britânico aprovou regulamentos para reduzir os efeitos prejudiciais, à saúde e ao meio ambiente, advindos da queima do carvão e da fabricação de produtos químicos. Essa breve recuperação histórica indica os principais (mas não todos) fatos ocorridos em termos de proteção ao meio ambiente nos últimos dois mil anos, revela que o direito ambiental não é o mais novo dos direitos, e, sim, que a partir da segunda metade do século XX ele deixou de ser um apêndice das regulamentações voltadas para a saúde pública para se tornar um campo independente, universalmente reconhecido, voltado para a proteção da saúde humana e da natureza não humana. Em termos de documentos históricos, antes mesmo da Declaração adotada durante a Conferência das Nações Unidas sobre o Meio Ambiente Humano em Estocolmo, no ano de 1972, foram editados vários documentos, entre os quais cabe exemplificar: em 1902, a Convenção para a Proteção das Aves Úteis à Agricultura; em 1911, o Tratado para a Preservação e Proteção das Focas Marinhas; em 1916, a Convenção para a Proteção dos Pássaros Migratórios; em 1931, a Convenção para Regulação da Pesca da Baleia; em 1933, a Convenção p a Convenção para a Preservação da Fauna e Flora em seu Estado Natural; em 1940, a Convenção sobre a Proteção da Natureza e Preservação da Vida Selvagem. Tudo isso revela que o direito ambiental tem importância milenar, o que revela a preocupação humana, utilitarista ou não, de realizar a sua proteção. Na atualidade, trata-se de um campo com grande repercussão, não apenas sob o prisma de sua regulamentação (ramo jurídico), como também sob diversos outros prismas (ramos da biologia, ecologia, bioética, energia etc.), o que confirma a imprescindibilidade de sua defesa e proteção para a sobrevivência e a qualidade de vida de todas as espécies que dele dependem, sejam da atual geração ou das futuras".
