"Protecting Cultural Objects" provides a comprehensive analysis, not only of the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, but of the historical background that led to the adoption of the Convention and of the ways in which it is implemented around the world. It also includes the texts of other significant legal instruments which seek to provide international protection for cultural objects. Theft and illicit traffic in objects of cultural heritage cause major problems for protection and conservation. This is so whether they come from archaeological sites, museum collections, private houses, or elsewhere. However, how to deal with these problems is difficult, particularly when the objects have been transported from one country to another. There are practical difficulties, such as identification and who pays for the investigative work, prosecution, and return of the objects. Overlaying all are the legal standards used to determine who the owner is and whether the objects should be returned. When UNESCO adopted the Convention in 1970 it was a truly significant event in the protection of cultural objects. This book studies the developments which led to its creation, and how it has been interpreted and implemented. The birth of the Convention led to a range of other instruments and techniques to protect cultural objects. Only some have been successful. These later instruments are studied here with suggestions for improvement. The final chapter looks to the issue of return, the mechanics of which received little attention in 1970. This book investigates China's demands for the repatriation of Chinese cultural relics 'lost' during the country's modern history. It addresses two main research questions: Can the original owners, or their rightful successors, of cultural objects looted, stolen, or illicitly exported before the adoption of the 1954 Hague Convention and the 1970 UNESCO Convention reclaim their cultural objects pursuant to remedies provided by international or national law? And what are the philosphical, ethical, and cultural considerations of identity underlying the international conventions protecting cultural objects and claims made for repatriating them? The first part of the book explores current positive legal regimes, while the second part focuses on the philosphical, ethical, and cultural considerations regarding repatriation of cultural objects. Consisting of seven chapters and an introduction, it outlines the loss of Chinese cultural relics in modern history and the normative framework for the protection of cultural heritage. It presents case studies designed to assess the possibility of seeking legal remedies for restitution under contemporary legal regimes and examines the cultural and ethical issues underpinning the international conventions protecting cultural heritage and claims for the repatriation of cultural heritage. It also discusses issues of cultural identity, the right to cultural identity and heritage, multiculturalism, the politics of recognition, cosmopolitanism, the right to cultural heritage, and other related issues. The idea of cultural heritage as an 'international public good' can be traced back to the Preamble of the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict, according to which "damage to cultural property belonging to any people whatsoever means damage to the cultural heritage of all mankind". How this idea of cultural heritage as a global public good can be reconciled with the effective enforcement of protection norms is the subject of this study. Bringing together world experts in protecting cultural heritage, Enforcing International Cultural Heritage Law examines the different ways that cultural heritage property can be protected, including protection at the international level, enforcement in domestic courts, and the role of alternative dispute resolution mechanisms. The book is divided into three sections. The first section assesses international law and analyses the interaction between international and domestic norms of public and private law. It discusses the different methods of international enforcement, the role of international and mixed criminal tribunals and courts, and the means for protecting cultural heritage in times of armed conflict. The second section addresses the role of national courts, discussing such topics as: barriers to domestic enforcement of international norms, the refusal to enforce foreign law, the difficulty of territorial boundaries in relation to underwater heritage, and the application of criminal sanctions by domestic courts.
