The principle of ,Äúbest interests of the child,Äù is firmly established in legal jurisprudence and has taken a firm hold on several domestic and global instruments. Generally, the courts rely on this principle in many cases of child custody, child work, child labour, and compulsory education. The norm of best interests of the child seems to be placed at the core of international law in relation to children,Äôs rights by Article 3(1) of the United Nations Convention on the Rights of the Child (UNCRC). Nevertheless, there is no one universal ,Äúbest interests of the child,Äù norm owing to cultural variations. In Ghana, this raises issues of conflicts between expectations in the rights and duties of the parent and the right of the child as expressed in the United Nations Convention on the Rights of the Child (UNCRC) and offers a genuine opportunity for reform. The United Nations Convention on the Rights of the Child (UNCRC) adopted the rights of the child that can be classified into three groups: protection rights, provision rights, and participation rights. It appears the best interests of the child is at the centre of international children,Äôs rights law which is articulated through Article 3(1) of the UNCRC. Presently, the advocacy of a child,Äôs right to welfare grounded on human dignity has generated the present discussion on the rights of the child. Article 18 of the UNCRC provides that parents have a shared and core responsibility for the nurturing of their children and that in undertaking their child upbringing responsibilities, appropriate support shall be offered to parents and legal guardians by State Parties. Usually, the variation between children,Äôs rights and parental rights, nonetheless, is not acknowledged by the UNCRC. Furthermore, the UNCRC views children to be competent individuals who should be an essential component of decision-making on issues affecting them. The parent/child contrast demonstrates that there is the need for cooperation that protects the rights of the child, the parent and defines the role of the state. There is the need to explore the best legal and judicial processes for realising this cooperation.

The Convention on the Rights of the Child (CRC), which was adopted unanimously by the United Nations General Assembly in 1989, marked a turning point in the perception of children in international law and policy. This edited volume, based on empirical research and Non-Governmental Organisation project data, explores the progress of the Convention on the Rights of the Child, and to a lesser extent, the African Charter on the Rights and Welfare of the Child, in nine African countries in the 25 years since it was adopted by the UN General Assembly. The book considers the implementation of the Convention both in terms of policy and practice, and its impact on the lived experiences of children in societies across the continent, focusing on specific themes such as HIV/AIDS, education and disability, child labour, witchcraft stigmatisation, street children, parent-child relationships and child participation. This paper demonstrates that the rights of women and children are not being protected effectively in Ghana. It argues that although Ghana has laws such as the 1992 Constitution, a number of international human rights laws that Ghana had ratified to protect the rights of women and children, and the Criminal Code (Amendment) Act, 1998, trokosi which discriminates against women and children is being practiced in the country. The paper attempts to answer why: (a) Ghanaian women and children continue to be oppressed in spite of Ghana's robust domestic and international laws that protect them? (b) the government does not enforce the trokosi law?, and (c) the 1992 Constitution has not been effective in eliminating violence against women and children Ghana? The paper anchors the trokosi practice in the paradigms of cultural relativism and universalism, and discusses the (i) presence of a strong patriarchal framework and the family structure which favours men over women in Ghana, the (ii) the secrecy of traditional religious practices, particularly, the trokosi rituals; (iii) the possible irrelevance of international conventions to Ghana's cultural and political situation; and (iv) the internal dynamics of Ghanaian politics. The paper concludes that trokosism persists in Ghana because of the conflict between culture and religious norms on the one hand and positive laws on the other.
