Recent decades have witnessed the proliferation in China of huge numbers of private universities and colleges in response to a wide-ranging spectrum of socio-economic and political demands under the country's flourishing market economy and its wholesale pursuit of decentralization. This book explores the issue of property ownership, an area which is regarded as an essential element in the attraction into the sector of local private institutions and foreign partnerships, as well as in facilitating the future development of the country's existing institutions. The focus throughout this book is primarily on the legal, economic, managerial and financial aspects of the relevant issues, as well as other related topics, such as consumer protections and fund-raising activities. A feasibility analysis and discussion is also provided on 'for-profit' universities and their potential market niches in China, in recognition of the fact that the current regulations-which allow private universities to maintain a non-profit status whilst actually enjoying profit returns-clearly provides some legitimacy to the phenomenon of 'for-profit in disguise.' It is argued in this book that such quasi-profit regulations may further exacerbate profiteering behavior, whilst it is also noted that, in the short term, there is a clear need to provide adequate protections within the apparent hybrid version of an ownership system-a system characterized by a mix of capitalism and socialism-through the adoption of a definitive legal framework within which economic actors can coordinate their efforts through a mutually understood framework of action. Finally, it is clear that in the transition from the 'rule-of-the-people' to the 'rule-of-law,' legislation, practices and compliance do not always go hand-in-hand in China; thus the healthy development of the educational sector will undoubtedly require some time, as well as the introduction of complementary mechanisms, for such legislation to be fully enforced in practice. This book concludes with policy recommendations on the existing property ownership system in China to address both the profitability and altruistic concerns of private institutions, and provides suggestions for areas which might be explored to facilitate ongoing sector development.

A human right to higher education was included in the International Covenant on Economic Social and Cultural Rights (ICESCR), which came into force in 1976. Yet the world has changed significantly since the ICESCR was drafted. State legislation and policies have generally followed a neoliberal trajectory, shifting the perception of higher education from being a public good to being a commodity able to be bought and sold. This model has been criticized, particularly because it generally reinforces social inequality. At the same time, attaining higher education has become more important than ever before. Higher education is a prerequisite for many jobs and those who have attained higher education enjoy improved life circumstances. This book seeks to determine: Is there still a place for the human right to higher education in the current international context? In seeking to answer this question, this book compares and contrasts two general theoretical models that are used to frame higher education policy: the market-based approach and the human rights-based approach. In the process, it contributes to an understanding of the likely effectiveness of market-based versus human rights-based approaches to higher education provision in terms of teaching and learning. This understanding should enable the development of more improved, sophisticated, and ultimately successful higher education policies. This book contends that a human rights-based approach to higher education policy is more likely to enable the achievement of higher education purposes than a market-based approach. In reaching this conclusion, the book identifies and addresses some strategic considerations of relevance for advocates of a human rights-based approach in this context.

Latin America higher education has undergone an astonishing transformation in recent years, highlighted by the private sector's growth from 3 to 34 percent of the region's total enrollment. In this provocative work Daniel Levy examines the sources, characteristics, and consequences of the development and considers the privatization of higher education within the broader context of state-society relationships. Levy shows how specific national circumstances cause variations and identifies three basic private-public patterns: one in which the private and public sectors are relatively similar and those in which one sector or the other is dominant. These patterns are analyzed in depth in case studies of Chile, Mexico, and Brazil. For each sector, Levy investigates origins and growth, and then who pays, who rules, and whose interests are served. In recent decades, we have seen the emergence of private higher education as a global reality. Although there are specific reasons for its appearance in each system, there is also a significant degree of commonality in the context and purposes surrounding the rise of private higher education as an important factor in many systems. The analysis of private higher education has tended to be focused at the national level, often highlighting national peculiarities and variations. In this volume the authors move forward by proposing a unifying and coherent, but flexible, theoretical framework that may be applied in different countries and diverse systems. Hence, the overall goal of this book is to provide a framework for a better understanding of the public-private mix of higher education and a set of policy guidelines in dealing with the expansion of private higher education from a comparative perspective. This analytical framework will be applied to four case-studies (Pakistan, Portugal, South Korea and Uruguay). These cases illustrate the diversity of contexts in the development of private higher education, though they also highlight important commonalities. Based on that analysis, we present some general recommendations to build a more effective policy-framework that takes advantage of the private sector in order to fulfill better the missions of the higher education system.
