European law, including both civil law and common law, has gone through several major phases of expansion in the world. European legal history thus also is a history of legal transplants and cultural borrowings, which national legal histories as products of nineteenth-century historicism have until recently largely left unconsidered. The Handbook of European Legal History supplies its readers with an overview of the different phases of European legal history in the light of today's state-of-the-art research, by offering cutting-edge views on research questions currently emerging in international discussions. The Handbook takes a broad approach to its subject matter both nationally and systemically. Unlike traditional European legal histories, which tend to concentrate on "heartlands" of Europe (notably Italy and Germany), the Europe of the Handbook is more versatile and nuanced, taking into consideration the legal developments in Europe's geographical "fringes" such as Scandinavia and Eastern Europe. The Handbook covers all major time periods, from the ancient Greek law to the twenty-first century. Contributors include acknowledged leaders in the field as well as rising talents, representing a wide range of legal systems, methodologies, areas of expertise and research agendas.

Collected Studies CS1071 The central figure in this volume is that of Gratian, whose monumental compilation of canon law sparked off the revival of legal studies in the medieval West. In other collections of essays, Stephan Kuttner dealt with the development of canon law in the two centuries that followed the publication of Gratian's Decretum, and the ideas that this engendered; here he is concerned with the foundations upon which all these later efforts were based. The work of Gratian is, of course, the principal focus, but the studies then follow the spread of the teaching of law, from its inception at Bologna in the 1140s to its appearance soon after in other centres of learning in the West especially in France, in the Anglo-Norman schools and in Germany. With a quarter of the volume consisting of additional notes and extensive indexes, it makes a contribution of the greatest importance to the historical study of canon law. For this second edition, a new section of additional notes has been supplied, and the volume is introduced with an essay by Peter Landau; these take account of the important recent work on Gratian and the Decretum and chart the significance of Stephan Kuttner's work.

Roman Law's Influence on Public Law and the State This collection of eleven distinguished essays explores the revival of Roman law and its subsequent influence on the development of public law and early modern theories of the state. "This very fine book deserves to be judged as something more than a mere collection of scattered essays. There is an impressive unity of thought and argument running through all the various studies, and together they form a coherent and extremely valuable contribution to a recent movement of thought that has been reshaping our understanding of the principles on which medieval government was based."--Brian Tierney, Harvard Law Review 78 (1964-1965):1502 GAINES POST [1902-1987] received an M.A. in 1925 and Ph.D. in 1931 at Harvard University. He researched medieval history and culture at the Ecole de Chartres in France from 1927-1928 and also conducted research in Italy, Germany, and England. Post was a member of the Department of History at the University of Wisconsin, Madison, from 1935 to 1941, a lecturer at the Riccoboro Seminar in 1947, and a lecturer at the Medieval Institute at the University of Notre Dame. Some of his many accomplishments include a Fulbright research award to France in 1951-1952, two Guggenheim Fellowships (1939-1940 and 1955-1956) and an honorary fellowship in the American Society for Legal History. While an instructor at Princeton University from 1959-1960 he was the chairman of the Institute of Research and Study in Medieval Canon Law. In 1954 he accepted a faculty position at Princeton University, where he remained until his retirement in 1970.

The late Middle Ages saw the emergence of professional jurists as a new functionary elite. The study approaches this phenomenon by focusing on a singular individual: Dietrich von Bocksdorf, Professor of Canon Law in Leipzig, learned counselor to the elector of Saxony, bishop of Naumburg. The book thereby breaks new ground. It offers not only a biography, but explores large and previously unused and largely unknown collections of more than 500 papers from the legal practice, written by the Leipzig Ordinarius. Based on this unique material the book examines for the first time spheres of influence, circles of clients and occupational fields of an individual late medieval german jurist. Legal opinions (“consilia”) and pleadings, but as well working tools for the emerging learned practice of “Common Saxon Law” made by Dietrich von Bocksdorf, provide deep insights into the beginnings of the epochal change from the traditional-archaic jurisdiction of the Middle Ages to the scholarly and written practice of law in the early modern world.

Jan Hallebeek will become emeritus in April 2019. That will mark an end to his professional career as Researcher and Lecturer on a Royal Netherlands Academy of Arts and Sciences post (1989–1999), as Professor Extraordinarius at the Theological Faculty of the University of Utrecht (1997–2006), and as Professor on the Chair of Legal History at the Vrije Universiteit Amsterdam (from 1999 onwards). These positions reflect two focal points of his research: on the one hand Church history and Canon Law, on the other hand classical and particularly medieval Roman law and their history. They matched very felicitously his engagement for and in the Old-Catholic Church. The contributions centre on the themes and questions the honorand has pursued in his work till now.
