Das Qualitätsmanagement einzelner Leistungserbringer in der gesetzlichen Krankenversicherung wurde im Jahr 2000 gesetzlich eingeführt und unterliegt seither einem dynamischen Entwicklungsprozess. Während die Qualitätsmanagementpflicht anfangs eher programmatischer Natur war, wird sie inzwischen durch eine Vielzahl gesetzlicher und untergesetzlicher Normen bestimmt. Das vorliegende Werk untersucht die rechtlichen Aspekte des Qualitätsmanagements in der akutstationären Versorgung im Krankenhaus. Schwerpunktmäßig werden dabei die zugrunde liegenden Normen des SGB V und die hieraus abgeleiteten Regelungen des Gemeinsamen Bundesausschusses betrachtet. Die Arbeit befasst sich zudem mit dem rechtsmethodischen Problem der Verwendung originär nicht juristischer Termini, wie zum Beispiel „Qualitätsmanagement“ oder „Qualitätssicherung“. Hierzu wird ein Auslegungsansatz entwickelt, der die interdisziplinäre Begriffsrezeption befürwortet. Der Autor ist als Jurist seit fast 20 Jahren im gesetzlichen und privaten Versicherungswesen beruflich aktiv. In der gesetzlichen Krankenversicherung verantwortete er dabei viele Jahre das Vertragsgeschäft der Innungskrankenkassen auf Landesebene. Seine bisherigen Veröffentlichungen befassen sich unter anderem mit dem Krankenhausrecht und dem sozialversicherungsrechtlichen Qualitätsmanagement.

This User’s Guide is intended to support the design, implementation, analysis, interpretation, and quality evaluation of registries created to increase understanding of patient outcomes. For the purposes of this guide, a patient registry is an organized system that uses observational study methods to collect uniform data (clinical and other) to evaluate specified outcomes for a population defined by a particular disease, condition, or exposure, and that serves one or more predetermined scientific, clinical, or policy purposes. A registry database is a file (or files) derived from the registry. Although registries can serve many purposes, this guide focuses on registries created for one or more of the following purposes: to describe the natural history of disease, to determine clinical effectiveness or cost-effectiveness of health care products and services, to measure or monitor safety and harm, and/or to measure quality of care. Registries are classified according to how their populations are defined. For example, product registries include patients who have been exposed to biopharmaceutical products or medical devices. Health services registries consist of patients who have had a common procedure, clinical encounter, or hospitalization. Disease or condition registries are defined by patients having the same diagnosis, such as cystic fibrosis or heart failure. The User’s Guide was created by researchers affiliated with AHRQ’s Effective Health Care Program, particularly those who participated in AHRQ’s DEcIDE (Developing Evidence to Inform Decisions About Effectiveness) program. The EUROHIS project has focused on the comparability of health surveys and has uncovered some problems that arise when aiming to compare data from different countries. Similar problems of cross-cultural comparability also arise when comparing data from other sources, such as health registers, and are just as complex and difficult to tackle. One of the main advantages of health surveys, however, is the relatively low cost and time involved in adapting them according to the needs of health policy-makers. This work shows that the output from the EUROHIS project provides common instruments for the measurement of eight health indicators. The development of these instruments has required careful consideration of relevant common concepts and how these should be defined and operationalized. The instruments are freely available for use by all countries, with the aim of enhancing national health information systems and facilitating cross-national comparisons of health data.
