Le rapport Travail à l’ère des plateformes. Mise à jour requise du Conseil national du numérique traite des mutations du travail à l’heure du développement des plateformes numériques de travail qui ont donné naissance à la notion d’« ubérisation ». À la suite d'une décision récente de la Cour de Cassation de requalifier un chauffeur Uber en salarié, la question du statut juridique de ces travailleurs, souvent micro-entrepreneurs, est longuement discutée : faut-il créer un statut ad hoc pour ces travailleurs atypiques ? Comment garantir les conditions d'une réelle autonomie ainsi que d'une protection sociale suffisante ? Enfin, le rapport se penche sur les mobilisations collectives récentes. Il explore la piste du dialogue social comme mode de régulation des relations entre travailleurs et plateformes. L’ensemble du rapport s’appuie sur de nombreux témoignages de travailleurs (chauffeurs de VTC, livreurs…), de leurs représentants, ainsi que des plateformes. Il met systématiquement en regard la façon dont la question est traitée en France avec les réponses apportées à l’étranger. Enfin, il s’intéresse de près à la dimension numérique de l’activité sur les plateformes, en traitant des questions de design ou de protection des données personnelles. Le rapport conclut en proposant 15 mesures afin de répondre concrètement à l’urgence de la situation des travailleurs, tout en engageant une réflexion plus large et prospective sur le travail à l’ère des plateformes, à l’image de la révision du statut et des protections des travailleurs indépendants, ou encore de la conception des outils numériques de travail, qui doivent être pensés de manière loyale et responsable. Le Conseil national du numérique est une commission consultative indépendante chargée d’éclairer le Gouvernement sur toutes les questions relatives au numérique.
