En el presente trabajo nos vamos a centrar en el análisis de la publicidad engañosa dentro del marco de las comunicaciones comerciales por vía electrónica. En síntesis, podemos afirmar que desde la perspectiva del comercio electrónico, la publicidad ha de ser entendida como una actividad cuyo objetivo es difundir vía electrónica, ideas asociadas a bienes y servicios capaces de persuadir a los sujetos destinatarios. En este sentido, la problemática a la hora de llevar a cabo esta comunicación viene dada no sólo por cuestiones económicas sino también por cuestiones vinculadas con la inseguridad jurídica y con la posible vulneración de derechos fundamentales básicos. Estos dos argumentos han motivado al legislador europeo y español ha introducir preceptos legales que eviten las prácticas comerciales abusivas. Si bien es cierto que la publicidad online se encuentra sometida a nuestro ordenamiento jurídico, en ocasiones la existencia de este régimen resulta inadecuado por lo que será complementado por el mecanismo de la autorregulación. Este fenómeno ha de ser entendido como un sistema desarrollado voluntariamente por las empresas con el fin de garantizar una publicidad transparente, legal y garantista.
