Die neue Erkenntnislehre der Reformatoren führte zu einem gewandelten Methodenverständnis gerade auch der Rechtswissenschaft. Daraus gingen eine neue Rechtsquellenlehre sowie eine gewandelte Gesetzeslehre hervor. Die Lehre der Reformatoren zielte auf ein neues Staatsverständnis, das an die Stelle des Papstes als Stellvertreter Christi den Herrscher setzte, der eine gottgewollte Ordnung gewährleisten sollte. In dieser sollte jeder Einzelne den Freiraum haben, sich im Glauben zu bewähren. Die neue Erkenntnislehre wirkte sich auf alle Bereiche der Rechtsordnung aus. Im Strafrecht betonte es die Aufgabe des Schwertes, aber auch die Chance auf Besserung des Einzelnen. Im Zivilrecht wurden die neuen ethischen Auffassungen übernommen und auf ökonomische Herausforderungen reagiert. Die konfessionelle Spaltung erfasste auch das Recht und verschliff sich erst allmählich im 18. Jahrhundert.
