Lo racional como razonable. Un tratado sobre la justificación jurídica, constituye, en palabras de su autor, una síntesis de ideas que fue formulando de manera gradual en conjunción de tres puntos de vista que fundamentaron diferentes estadios de su labor científica: la denominada Nueva Retórica, la filosofía lingüística del último Wittgenstein y el enfoque racionalista representado por Jürgen Habermas. En este libro, el autor examina la relación entre los términos "racional" y "razonable", cuyas diferencias y el hecho de que la interpretación jurídica se encuentra más cerca del dominio de la razón, si bien fueron evidenciadas por Chaim Perelman, no dejan de ser términos con un vínculo ciertamente complejo. El autor considera que la interpretación jurídica requiere una intelección exactamente analizada de la conexión entre estos dos conceptos, conexión que es también útil para la comprensión de que, además de los rasgos racionales, en la interpretación jurídica se confiere una posición central a la teoría de los valores, especialmente a la teoría de la justicia.

"La presente obra trata aspectos fundamentales para el estudio del derecho contemporáneo: La relación de derecho y justicia, la irracionalidad del ulterior concepto y la definición del primer término; partes que intentaré explayar aun con un conocimiento mínimo del derecho en general. En la primera parte se dividen los conceptos de justicia partiendo de las definiciones clásicas (dar a cada uno lo que le corresponde, etc.) y las definiciones de justicia universal (reside en la relación individuo - Estado) y justicia particular (sea esta distributiva o restitutiva) para así fundamentar el cisma teórico. La justicia, de esta manera, se divide en tres grandes ramas: las teorías analíticas (relación de la lógica y la lingüística con la justicia), las teorías empíricas (explicación histórica, sociológica o económica de la justicia) y las teorías normativas (justificación de la justicia y valores éticos), las últimas de suma importancia para la filosofía del derecho. En la segunda parte trata la irracionalidad del concepto de derecho; irracionalidad teniendo varias definiciones desde las teorías filosóficas que valoran lo irracional (o lo sensible a mi forma de pensar) frente a lo racional (viz. Nietzche y Kierkegaard) hasta llegar a su evolución contemporánea personificada en varios movimientos como los ecologistas y también en la filosofía analítica".
