Le 20 novembre 2014, Anne-Yvonne Le Dain et Laurent Marcangeli ont présenté les conclusions de leur rapport d’évaluation de la lutte contre l’usage de substances illicites devant le Comité d’évaluation et de contrôle des politiques publiques (CEC) qui en a autorisé la publication. Les rapporteurs constataient que la politique de prohibition adoptée par notre pays depuis 1970 et les moyens importants qui l’ont accompagnée n’ont pas permis d’obtenir des résultats probants sur la consommation de produits illicites, notamment le cannabis, dont la prévalence en France est parmi les plus élevées en Europe. Ils plaidaient en faveur d’une remise en cause de certains modes d’action et faisaient en ce sens une douzaine de propositions conjointes autour de trois axes : – bâtir une véritable politique de prévention à l’égard des plus jeunes, fondée sur des programmes scientifiquement validés et évalués ; – décloisonner les dispositifs afin de faciliter les parcours de soins individualisés dans la prise en charge sanitaire et sociale ; – poursuivre et approfondir la politique de réduction des risques en renforçant le contrôle des traitements de substitution aux opiacés et en développant les programmes d’échanges de seringues. Les rapporteurs avaient en revanche des avis différents sur l’expérimentation des salles de consommation à moindre risque : Mme Le Dain y était favorable, au vu des expériences étrangères comparables, alors que M. Marcangeli s’y opposait, faute de sécurisation suffisante du dispositif. De même, leurs positions divergeaient sur la portée de la révision de la loi de 1970 et du régime de l’usage individuel de cannabis : alors que M. Marcangeli souhaitait substituer au délit actuel une contravention respectant l’individualisation des peines, Mme Le Dain se prononçait en faveur d’une légalisation dans l’espace privé pour les personnes majeures et d’une offre réglementée du produit, sous le contrôle de l’État. Un an après la publication de leur rapport, les rapporteurs ont présenté devant le CEC leur analyse de la mise en oeuvre de leurs recommandations, afin de tenir compte des résultats des nouvelles enquêtes et de faire le point sur les dispositions adoptées lors de l’examen du projet de loi de modernisation du système de santé.
